Bard's fascination [Archive] - Wizards Community

This is the plot:
My DM loves Bards.
My DM's gf is a Bard.
According to my DM, when I'm engaged in combat with a bard, even after the first round has happened so we are clearly in combat and I'm atacking her constantly, she can use Fascination to fascinate me, and I'll just stare at her like a stupid not doing a thing until she casts a spell, atacks me or something similar.

I know the "DM is always right" thing, but ignoring that and according to WOTC's real rules, can she do taht once the combat round has been shot?

There's an area in wich it says that the effect is ruined by a nerby combat, but according to him, [my] combat is not a nerby one, we'd need someone else fighting nearby.

Plot number 2:
Can a chaotic neutral bard fascinate a Protected against Chaos by the spell of that name, character?

The thing is that dont matters that you are hostile agaisnt the bard but matters if the bard (or someone else close to you) is hostile agaisnt you.

Once again, did the bard anything threatening?
If he drawed a sword, yes, he cant use fascinate, ever if the bard taunted you or said anything threatening then he could not fascinate you. But while the bard is bare handed just avoiding being killed he is not a threat.
Of course in an arena with a big amount of people would be hard to keep of start a fascination if people starts to insult and threat the fascinated one, in that case is the other people who makes the fascination imposible and not the bard itself.

Arcane casters can cast any spell unlike clerics that have that restriction of no oposite aligment spells listed.
