The Plague zombie in Libris Mortis has his combat tactics defined as, tries to get enemies as close as he can, so he can infect them.

So, what if, as my silly little PCs are moving in on him, thinking of how to attack him without touching him, he starts waving his arms and chanting, like a spellcaster? He doesnt have any spells, but hopefully they wont know that. They get an AoO, and smack him, and get all kinds of nasty disease.

An interesting idea, that can be easily avoided witha spellcraft check. Otherwise, pretty neat.

By the by, did you realy mean to post this the character development boards? It seems rather out of place.

Not sure. See, uh, its definitely not a min/max trick, but its not a character story. its just a kind of feint that isn't governed by the numeric rules, per se....thoughts churning....

Anyways, I just figured since it was something a "character" (even a highly disposable one) does, and not some trick of splatbook, that this was the better place.

Any character should be able to just willingly provoke an attack of opportunity. So your trick would basically work. You could just - as you said - describe that he is chanting and waving his arms. Then i would allow the characters a knowledge/arcana roll. DC 5 to recognize he's not using regular arcane magic, DC 20 to know he is not channeling magic at all, DC 30 to know he got this diseases. An additional Sense Motive(DC 15) if the previous check was 20 or better should also make clear that his goal is that you start to attack.

that is hilarious.

What would you do if someone attempted a counterspell?

To counterspell, you must first make a spellcraft to identify the spell; I guess if you are successful at this check, you know this is not a spell!

I would also allow a Sense Motive check to allow a PC realize the undead is feinting...
