So those ever toiling, ever suffering souls in Dis and Maladomini - are they just those deemed to worthless to become lemures even? What distinguishes them from the petitioners that are allowed to rise through the ranks of fiends?

Some of them probably were, in life, sniveling cowardly petty tyrants and bullies who were mockeries of LE. The majority, though, have probably been tricked into the toil by their fellow petitioners, who proceeded to rise through the ranks. Gods know how many are searching their contracts for loopholes and gaps in the rules.

And a reasonable number will be hideously strong anti-Paladins and Blackguards and the like. My guess is they'd get rank above Lemure as soon as they arrive.

Assuming that LE petitioners are sent to Baator, who's to say that their deity doesn't prevent their ascendence to being devils?

I mean, if I were a LE deity who happened to resent devils because Asmodeus banished my divine realm from Baator to one of the other evil planes (or to the astral plane), I'd be drawing my petitioners to my realm. If those devils want my people, they'll need to bargain with me. I'm not gonna let them take my souls. No, sir.

But if I was a deity whose business was heavily buried in the business of the devils, sending my devotees to become devils might be a good idea. More troops! More meatshields!

As for advanced devotees - blackguards and the like... Who is to say that their deities or archfiends won't just resurrect them or raise them as undead?
Why get another lemure or imp when you can get a blackguard instead?
And why get a blackguard if you can get a mummy blackguard? Or a vampire blackguard? Or a lich blackguard?

Thanks for registering for the draft of Baator, your draft card will now be taken from you and appropriate templates applied so as to prolong your usefulness to the lawful evil tyrants of the stars, planes, and universes.

Don't petitioners of a specific deity go to their divine realm, and only those who are heathens / directly corrupted to Evil go to the nine hells?

Sure, some L/E deities make their homes in the hells (And one odd choice of a C/E deity of Hostility... but I'll stop whining about Setekh's poor treatment for now) but don't they have their own sector for themselves.

Yeah...the really vile/awesome ones will definitely be turning into something level-appropriate.

Also, take into account that there, among them, are the ones destined to become Hellborn, you've got people that were evil and tried to redeem themselves in the last minute. You've got good people that started being evil at the end of their lives. And you can't compare the soul of a guy who eluded taxes through the law than to a guy that made himself emperor and turned the kingdom into a powerful evil place.

Set has always been LE in terms of the Set living within the 9 Hells for 3 editions of D&D.

Some souls who don't become larvae or aren't twisted into lemures almost immediately upon entering Baator might remain in their forms as in life because of certain bylaws and contractual wierdness involved in just what they did in life, who they served, who they worshipped, etc. Some of them might be cases of a soul claimed by multiple LE gods lairing in Baator, and the fiends happily hold on them in escrow while the quarreling powers argue. Some of them might be souls claimed by multiple lords of the 9, or claimed by more than one type of fiend outside of Baator (and the soul happens to be LE so goes to baator by default).

The status might be a catch-all holding ground for multiple situations that preclude the soul moving on to some other end status, be that a lemure roasting in Phlegethos, or a slave building Set another pyramid, or a diced up larvae simmered in gnome-blood on my dinner table because he 'lothed out on a contract he'd signed with me before going lawful evil and I'd filed a claim with the appropriate ministry.

You're partly right. In 3E, mortals end up on the outer plane that matches the alignment they held in life. This happens no matter what religion the character has. LG characters go to Celestia, CN characters end up in Ysgard, NE characters end up in Gehenna. For some characters, most clerics and paladins specifically, this means they will end up in the home plane of their deity. For example, a worshipper of Tiamat will end up in Avernus, the First Hell of Baator, because that's where Tiamat's divine realm is. She is worshipped by a few types of devils. The abishai, specifically, pay special homage to her, as she created them, if I remember right. If the individual worshipped some other LE deity, they would end up in the divine realm of that deity, such as Acheron for Hextor.

Sorta yes. The abishai were created as a collaborative effort between Tiamat and Pearza of the Dark Eight. Without the direct aid of that particular pit fiend, as a deity she probably wouldn't be able to create what ended up a true caste of baatezu. As befits the plane, the relationship between Tiamat and the plane's natives is pretty byzantine. :)
