when you level up do you get the same amount of skill points as your intelligence score? or is it the modifier

it is how many you get from your class + your int mod

ex. wizards 2+int mod (X4 at first level), rogues 8+int mod (X4 at first level)
Every level after first it is not X by 4.

It is your unenhanced Intelligence modifier. For instance, a human wizard with Intelligence 15.

1st level
(2+INT mod)x4 + 4 (human) = (2+2)x4 + 4 = 20

2nd level
2+INT mod + 1 (human) = 2+2+1 = 5 (total=20+5=25)

3rd level
2+INT mod + 1 (human) = 2+2+1 = 5 (total=25+5=30)

4th level, the wizard increases his intelligence to 16.
2+INT mod +1 (human) = 3+2+1 = 6 (total=30+6=36)
The wizard also finds a Headband of Intellect +2 (Intelligence is 16 enhanced to 18)

5th level
2+INT mod +1 (human) = 3+2+1 = 6 (total=36+6=42)

Note that at 5th level, the wizard did not gain extra skill points for wearing the headband of intellect. This is because magical enhancements do not grant additional skill points.

It is because the rules for Headband of Intellect specifically state that it does not grant extra skill points. Any ability booster, even one that provides an enhancement bonus, that does not contain that clause, will increase skill points.

Not quite. It is not only because the Headband of Intellect specifically states it, but also because the PHB specifically states it. Any non-permanent effect (like a magic item that can be taken off) does not permanently increase skill points. Here is a reference from the FAQ:

If a character levels up after taking Intelligence damage does the number of skill points he receives for the new level depend on his normal Intelligence score or his damaged score? What if he takes ability drain instead of damage? What happens to his existing skill ranks?
As noted on page 38 of the Player’s Handbook, only permanent changes to Intelligence affect the number of skill points you gain when taking a new level. A character with Intelligence damage gains skill points based on his normal (undamaged) Intelligence score, while a character with Intelligence drain gains skill points based on the adjusted score. Either way, this has no effect on his existing skill ranks. Permanent changes to Intelligence don’t retroactively change your number of skill ranks from previous levels.

I checked my PHB, and page 38 says no such thing. The page deals with the Fighter class information.

I found it on page fifty-eight though. I don't think I'd noted the particular paragraph before.

Even so the general principle is that whenever an ability changes, the new ability is used as the actual score for all purposes, unless some rule says otherwise. The rule about skill points not changing from temporary sources is just more general than I'd realised (I certainly was not aware that ability damage doesn't change skill points).

But would the order of sources put the DMG before the PHB on this one? Technically, the DMG is the magic items lord, but phb is more like mechanics, and this effects both.

Obviously, as it is in the FAQ, this will stand, but curious anyways. Also, all it would take is a magic item WITH a new clause to give you them. Most resonable DMs would prolly give you a wonderous item you create for this.

I tend to disagree. Wizards was asked why you do not gain the bonus from the Headband of Intellect. They said it was because it could be removed. Warforged with embedded components that affect Intelligence would still not gain the benefit of additional skill points because even embedded components could be removed. Now, if you were permanently enhanced with Intelligence (such as through the reading of a Tome of Clear Thought), you would gain more skill points each level, because the effect is permanent on you, not a permanent item that you happen to have, but is not permanent if you lose it.

Edit:
Because the tome of clear thought provides an inherent bonus, the reader will earn extra skill points when she attains a new level.

If a specific item said that it did grant skill points, that would be a different story.
