Okay, so I've got this idea...

Also I'd like to know if Wizards... would have copyright on the name "Sons of Gruumsh" if I wanted to use it as the name for a stoner/rock'n'roll/pop - band...

Sort of Kyuss meets Hidden Cameras/Beatles/Belle and Sebastien. Anyway, stupid idea, but we're gonna do it, we've all been playing in bands for years, but we're gonna do it in the style of Orcs/Lordii/Gwar and sing about killing Elves and stuff...

...also is it considered "Race-Hate" to sing about killing Elves?

For the name "sons of gruumsh" I don't know but for songs about killing elves and stuff it's already a hit in France and in Québec with the Naheulband. But their musical style is more celtic.

Hey, I want to know this too.

It'd "kind of" make sense for rock/metal music to make it into some fantasy settings; barbarian tribes etc. Good for getting the troops roused - and I've seen the odd David Coverdale-inspired rogue (sorry rouge). Awesome.

Reminds me of the band I put together in a game once (was a bard)

We had me, a half-elven lyre-player. I also worked in spells into the show, ex: glitterdust/illusions. Kinda pyrotechnics.

We had a hobgoblin who could absolutely shred on his mandolin. But, he was ugly, so he never really got much work.

There was a tiefling drummer, who was pretty good. He had a flaming goatee.

We had dwarvin women who was the vocalist. She was a growler, a la heavy metal. She was a bit of a diva, but she really got the crowd going.

And we had 2 halflings, one played the pan pipes, the other played a lute.

Only me and the hobgoblin were bards, the rest were just good with their instruments. :D

In the last game I was with the band, we played at a noble ball. Just my luck, my glitterdust spell not only enlivend the crowd, but revealed a invisible assassin!!! :O It was a fun game... :D

Here is an item I hade awhile ago for something similar, It was for the Realms, feel free to use it and change the history if you want.

Mandolin of Drixon: Originally created by the bard Jorron Drixon of the Moonsea area. Jorron disappeared after a performance in Mulmaster some 50 winters ago. It was no secret he had following in many cities surrounding the Moonsea, including Zentil Keep. It was even said Manshoon once attended a performance and was “intrigued” at the fanaticism some of the audience displayed. Several copies of this mandolin have been made based on its known powers. It is believed the original has greater abilities that can be unlocked by discovering the correct cords or riffs.
Lesser Mandolin of Drixon: This item works only for those with 3 Ranks in of the Perform (Mandolin). They have a unlimited use of Amplify Music effect, controlled by a command word, so as to be played without the amplification. This instrument also has the following abilities usable by strumming certain cords in particular octaves. The ability to strum the correct cord will interrupt any bardic ability being used.

By means of this spell, all music, singing and rhythmic speech (ie. Poetry, etc) created by the caster, either by voice or instrument, is amplified to carry greater distances. The edge of this spell, all amplified sound is at the same volume as if the caster occupied that spot. This increased distance allows a bard to use his Bardic Abilities at a greater range. A 10th level bard can fascinate a creature at a distance of 240 ft (50ft + 100 ft for levels and + 90 ft per the fascinate ability). Normal spoken communication is hindered at close range, and loud enough to cause a distraction to spell casters. Listen checks are made at a -20 penalty in squares adjacent to the caster (while music is active), decreasing by 2 per 5ft. Any spellcaster attempting to cast a spell with a verbal component within 20 ft of the caster must succeed a Concentration check(DC 10) in order to cast the spell. This spell is commonly used by bards to increase the size of their audience.

To answer the original question, yes, Wizards are bound to have the trademark on the name "Gruumsh". It's not OGL, after all.

Whether they have it trademarked or not, they are unlikely to be able to prevent you from using it in the name of a band. Trademarks require some degree of competition. A band name in no way causes confusion with a roleplaying game supplement.
