On p.22 of the ECS, part of the Treaty of Thronehold "Secondly, House Cannith were forbidden to produce any new Warforged, the creation forges were shut down and destroyed."

Which was signed in 996.

Random starting ages for warforged are 0 + dX, therefore its acknowledged that there are Warforged created after this point. "Known" sources being Merrix d'Cannith and The Lord of Blades.

How illegal is/was their creation, and how does this affect thier (the new warforged) status?
By the wording presented to us, the Lord of Blades is not a member of House Cannith, he's not broken the treaty, with the obvious rebuttal of at the time it was thought that only (dragonmarked) members of House Cannith could operate a creation forge. Although the Lord of Bladse never signed the Treaty of Thronehold.
As for Merrix, he is presumably, working on warforged without the knowledge of the rest of his house, especially the other two leaders. Is the House responsible for the actions of its individual members, is the "Board of Directors" being criminally negligent in either not finding out or doing anything about it if they find out.
If it is discovered that Merrix is making new warforged is Merrix culpable or the entire house.

As for the Warforged created illegally, its implied that the creation process is illegal not being a new Warforged. But what would happen to an illegally created Warforged. Do you say sorry and kill them? Do you um and err and let them be on their way becasue its not their fault? Imprison them? or the old favourite indertured servitude?

If House Cannith's forging operations were discovered, they would probably face confiscation of their equipment, censure, and stiff financial penalties under the statutes of the Treaty, and senior (but not too senior) House members would face early retirement as scapegoats. Beyond that, they could probably tie up the issue in legal red tape almost indefinitely.

The Lord of Blades is a terrorist, probably with plenty of capital charges hanging over his head if he is ever caught. There's no need to try and pin an Illegal Forging charge on him as well. The remainding members of the Cyran nation along with House Cannith might bring additional charges of trespass and misuse of House property, if they felt so inclined.

I doubt any newly-created Warforged would face punishment, but they might well face stiff interrogation and examination to ensure that they have no new special properties - mental or physical - that could make them a threat to others. Aside from that, I think they'd be allowed to go on their way.

I've often wondered just how safe the secret of the illegal forge under Sharn that Merrix runs is and I have also often wondered just how cognitive that warforged are at the time of thier birth. Assumming that they are as ready to go straight from the forge as I've read, then I assume that they are pretty aware. So, lets say that they are aware from "birth", What's to say that a warforged made at the secret lab will be loyal to Merrix? I mean what if one inadvertantly slips up and mentions it to someone who has some vested interest in upholding the treaty, or just has a vendetta against Merrix or House Cannith? Something that big would probably go along way to shattering an already fractured house.

I guess I basically just wonder what type of control Merrix has over what they [the warforged] know or what they reveal? I think most warforged made in the illegal lab could keep it secret just based on a loyalty to the race issue and seeing it as a positive for the population but the bad thing about secrets is no one can keep them forever.

In a campaign I'm in I play a Warforged created by Merrix d'Cannith and I am working to procure dragonshards for him. I am completely loyal to him at this point. However I do not ever reveal any of this as I am working with others that beieve they are searching for dragonshards for someone else.

I'm not really sure what my DM will do if I ever let the secret slip. He already knows all this because he asked us to write up some history for our characters. I take comfort in knowing that at 2nd level I could probably take out the rest of the party by myself.... you know ... if i really had to that is ... hehe

I guess that's the really safety there. Who's going to ask a 'weapon' were it came from, especially one that can slaughter a whole guard detachment. Most people assume that Warforged are just leftover tools of a distasteful war. Their not even going to stop and ask how its feeling today let along integrate it about its past. As for the Warforged remembering were it was 'born' that could be hidden though post-forge creation. I can't think of any good rules but that doesn't prevent a plot based excuse. Merrix messes with their auras/enchantments or something.

Pretty simple really to pull off: The new warforged don't know they are being created by Merrix. He is always in disguise when he is working the creation forge. They know only that it is a member of House Cannith not who it is exactly ;)

Ever see star trek the original series episode "I, Mudd"? Merrix' situation doesn't seem all that different from Harcourt's. He's using the warforged for his own purposes, but it might just turn out that they're using him as well.

Well, the forge is hidden in the Cannith forgehold in The Cogs. So you have to get into the forgehold first. Even then, Merrix is one of the best craftsmen around. Ever seen one of his fabulous secret doors? Of course not.

Merrix only uses the forge sparingly, so there aren't that many warforged he made wandering around. Likely, he keeps many of them loyal to him to further his lawful evil schemes and to assist him in indulging his interest in the warforged's role in society.

If Merrix creates new "wild" warforged, he probably has some way of activating them one they've left the forgehold.

One of my players had his warforged monk killed after a nasty encounter with Sabre, Agent of the Lord of Blades, who pushed him off a very high bridge in Sharn.

Later, the player's new character, a warforged fighter, turned up, looking for the monk. Though the new warforged was actually the old one, who Merrix had found and remade with a new body, creating a new personality based on someone the monk knew during the war.
Though the Campaign didn't last, so the whole identity crisis never came up.

Why would there not not be a multitude of warforged already created, just not in use?
Surely Merrix or whomever would not create them 'as ordered'.
In my game i have a storehouse of multitudes of them waiting to be unleashed, similar to the I Robot movie. However, mine are well hidden behind Merrix's secret doors! MUAHAHAHAHAHHAHAHAHh...*cough*cough*...h ahaha....

The problem with the warehouse full of WF waiting to be "activated" is that I'm not sure that WF can be "created" without coming to sentience. Remember that only one robot in I Robot would be truely analagous to WF. I'm not sure how the idea of Merrix "activating" WF would play out, does he have "mind control" spells/effects/items... docents??? I think it's doable, just not straigt forward. Does Merrix have something like a dragon orb that controls WF? If so what happes when a player's high level character gets taken away from him because Merrix would like to use the WF's power for himself?

In my game if the new warforged were found out they would be siezed and destoryed. I"m actually using this as tension in the game.

I have someone playing a warforged who is very into the whole fate of his race thing. So I've established the general dim view, especially in Breland, of Warforged from the war. It's also fairly obvious that many people blame Cannith for what happened to Cyre. If house Cannith were found out to be building a private army and people thought they were toying with magics that destroyed Cyre we could have another purge like happened to house Vol on our hands.

This is how I've set the stage in my campaign anyway. The tension comes from the fact that the player in question has notice there are several warforged in the Cogs who are new. It's interesting watching him struggle with what to do about that information.

I always pictured the warforged as having to be built then ran through the creation forge to bestow the sentience into them. Kind of like building a contruct then having to enchant it with magic in order for it to become functional. Basically they are inert waiting for the forge to magic them into life, because I do not picture a creation forge actually assembling them. Otherwise it would have a bunch of mechanical arms and such for actually constructing them. This also would allow for mass production that would be require to build the armies of them. Build them by hand then send them through the creation forge. Just my take on it which I implemented into the game as it seemed more logical.

That sounds like a great question for the Ask Keith Thread.
I tend to agree with your theory also. I pictured them somewhat similar to the droid army in SW Episode I. jsut warehoused built but inert until they were placed into the forge. I'd ask Keith, I bet he can clarify it. :)

But the reason that it became illegal to make warforged is because they were considered people, and were being manufactured to be sold into slavery. The creator(s) would be held accountable if they were caught, but punishing the warforged for being alive seems like it defeats the purpose.

So to the OP, I'd say that there would be no punishment (Besides, how could anyone tell a warforged's age? They don't have childhood.), but if a new warforged were somehow found out, he/she/it would be questioned about where he/she/it came from. As for whether all of House Cannith can be held accountable for Merrix's actions, I have no idea--but I bet if either of the other leaders found out they could definately turn it against him and only him.

That would explain how they build the different kind of warforged, of different sizes and different classes, too.

And if you look at the creation forge picture at page 22 of the ECS the human-like figure on the bottom could perfectly be a warforged that is being actived, so the teory make sense.

I agree that is what the treaty of thronehold says but I strongly disagree that most citizens see it this way. Also there is no real reason for government to see it this way. The warforged story has been played out many times in literature already usually in the form of cloning. Sci-Fi is full of stories of clones and an exploration of what constitutes a "person" as well as illegally created clones having to live in fear of being destroyed.

So any argument that they absolutely have nothing to fear is unfounded.

As far as age, this is uncertain territory. For the story I'm running I've told the Warforged they notice differences in each other that any other race could never could. It's just a play on the "you all look the same to me" trend that would run between races. So to my players I've told them they notice differences in the texture of the wood and the "skin" in a Warforged that is under six months old.

The situation gets even more difficult if you run Eberron as the complicated world it is written as. All it would take is rumors of secret warforged armies being created to spark riots in some parts of the world. Purges have happened many times in Eberron, so a purge of warforged lead by popular movements instead of governments aren't out of the question. If a warforged player is concerned about the future of his people, shutting down a source of new warforged would be a terrible thing to them.

There are also problems on the human side. House Cannith is already fragmented, so Merrix's actions could cause an official split or even an civil war within the house. What of the other houses got involved to enforce some kind of laws between the Dragonmarked Houses, we could end up with a house war.

One of the strong themes in Eberron is the tension in the world, the Last War isn't over, everyone is just catching their breath. Trying to dismiss that tension doesn't really play well to the world.

I appreciate your views, but you're presenting them as if this is the only possible way it could be seen which is just a bad position to take. I'm really just using story elements that have been a staple of sci-fi and fantasy since the beginning.
