Okay, I'm confused. I thought that if you where not proficient with armor, you take the armor check penalty on Balance, Climb, Escape Artist, Hide, Jump, Move Silently, Sleight of Hand, Ride, and Tumble checks, but if you where proficient, the ACP no matter how high, did nothing. Now I'm lead to believe if your not proficient, you take the penalty on Balance, Climb, Escape Artist, Hide, Jump, Move Silently, Sleight of Hand, Ride, and Tumble checks AND attack rolls. But if you are proficient, you only take a penalty on Balance, Climb, Escape Artist, Hide, Jump, Move Silently, Sleight of Hand, and Tumble checks. What one is right?

Without the books in front of me I believe it is the second one. I can't remember what else you take it on when your NOT proficient. You will take it on Balance, Climb, Escape Artist, Hide, Jump, Move Silently, Sleight of Hand, and Tumble if you are proficient.

Here you go.

Armor Check Penalty

Any armor heavier than leather hurts a character’s ability to use some skills. An armor check penalty number is the penalty that applies to Balance, Climb, Escape Artist, Hide, Jump, Move Silently, Sleight of Hand, and Tumble checks by a character wearing a certain kind of armor. Double the normal armor check penalty is applied to Swim checks. A character’s encumbrance (the amount of gear carried, including armor) may also apply an armor check penalty.
Shields

If a character is wearing armor and using a shield, both armor check penalties apply.

Nonproficient with Armor Worn

A character who wears armor and/or uses a shield with which he or she is not proficient takes the armor’s (and/or shield’s) armor check penalty on attack rolls and on all Strength-based and Dexterity-based ability and skill checks. The penalty for nonproficiency with armor stacks with the penalty for nonproficiency with shields.

To sum up:

If you are proficient, then you take the penalty to skill checks.

If you are not proficient, then you take the penalty to skill checks, attack rolls, and ability checks.

Proficiency only affects attack rolls: you take penalties to attack rolls if not proficent is armor has armor check penalties.

Example anyone can wear without penalty padded, leather, and masterwork studded leather as all have armor check penalty of -0.
Also mithral Chain shirt.

But all other armors need proficiency or get penalties to hit.

Armor check penalties primary affect is on physical skills: no amount of proficiencies will help. Tower shield will always affect these.
