If I have an animated tower shield then can I use a two handed weapon at no penelty or am I missing something?

I've said it before I am a noob and I don't have any one that has played this game alot to ask .

You are quite correct. An animated shield protects as a shield but doesn't take up a hand/arm slot. It does, however, contribute to ACP and/or spell failure (if either matter to you). It's one reason why animated shields are considered broken by many (including me) since you get to have your Sword and Board 'cake' (AC) and eat it too (Two-Handed damage which is the best in the game).
