OK, the process seems fairly straight forward, but I've got one main question.

A weapon of Legacy is almost by default assumed to start out being a magical item. In this case, a magical spear. The most basic magic weapon is the humble spear+1.

Now, the question is thus. In the Legacy abilitys menu A it lists: "Weapon enhancement: Your weapon gains an enhancement of +1". Does this ability increase the basic enhancement of the weapon by +1 (stacking with the initial "basic item" enchantment), or does it override the initial enchantment, and is thus useless in this case?

I don't have my copy in front of me, but I'm pretty certain that any and all enhancement bonuses gained through legacy improvements stack. I recall the book stating something along the lines of "non-magical items aren't unique enough to start a legacy, and +2 or more weapons are too set in their magic" or something like that, but the end result is that they strongly encouraged only +1 items for legacy founding. Since every addition is supposed to make the weapon stronger, it wouldn't make sense to grant it the +1 and not stack.

Yes, that's the gist of it. They actually say that masterworked (non-magical) items <I>could</I> become a legacy item, but these are extremely rare. And higher category magical items are even rarer, from what I can tell.

That's the way I understand it, but it was a debateable point, thus asking on here if anyone had any clarification (or baring that, popular support). I powergame in enough campaigns as it is without doing it unintentionally in one where I'm not. :p Especially on a point that might be violating the spirit of the rules, if nothing else.

Lots of the example weapons become a +2 weapon where you could only pick an a-menu ability AFAIR.

That +1 is useless to a Legacy item that already has it. For a weapon that has different magical abilities to start, then it's useful.

Notice how the B menu reads "the weapon's enhancement bonus increases by one, to a max of +2"? That one stacks. The A menu doesn't.
