What is the general consesus of a creature immune to constitution damage (undead or someone with a magic item to make them so) using this ability? Can they just plain not use the taking con damage for extra damage, or do they get it 'free of charge'?

Though the FAQ for Dark Speech is that undead lose Cha in place of other damage, so probably.
