04-15-07, 07:55 AM There is a situation that i want some opinions on. Can a rogue in the 3.5 edition make a sneak attack with an an enervation rod,wand or scroll (by using the skill "use magic devices")? If yes what are the effects? Does the victims looses the sneak attack damage as level drain? I have read that this could happen in the 3rd edition. Does the rule about damage (PHB 3.5, pg 134 - "Damage reduce's a target's current hit points") applies?

04-15-07, 08:50 AM The answer to your question is quite clear, as it's the first comment in the section you're talking about.

Any spell that requires an attack roll and deals damage can be used in a sneak attack. In this case "damage" is normal damage, nonlethal damage, ability damage, or energy drain.

05-01-07, 09:58 AM Correct; the extra damage from sneak attack is always hit point damage regardless of the effect of the attack itself -- the type of damage only matters if the target has resistance or vulnerability to it.

Sneak attack with an enervation spell adds Xd6 (magical, negative energy, lethal) damage, just as a sneak attack with a longsword adds Xd6 (physical, slashing, lethal) damage, or a sneak attack with a fist adds Xd6 (physical, bludgeoning, nonlethal) damage.
