For example, a Beguiler's 7th level slot can only be used to gain a 3rd level or lower spell from the Sor/Wiz Enchantment or Illusion lists, can it be retrained at 8th level to select a 4th level or lower spell?

Definitely not. Retraining must have been a legal option AT THE TIME. As retraining to a spell slot that they couldn't select at the time is illegal. Just check if it was legal at that level when you selected the advanced learning. If it was then its ok, if not, then no.
