Just trying to find out if there is a form my Bard can take under the Alter self spell that has wings?(and flight)

It has to be the same type right? ( humanoid)

Raptorians from Races of the Wild, but you have to be at 11 or 12 hit dice to fly without hinderance.

My DM ruled, because 1st level spells don't improve over CL 5, that you can't get an actual fly speed with this.

While it's true that the spell doesn't improve, your character still has as many hit dice as it did prior to your alteration. You turn into a 5 or fewer hit die creature, not lose everything down to 5 hit dice. That just means that as long as the base creature's base hit dice are fewer than six, you may turn in to it.

DM ruling incompatible with Rules.

Alter self is a level 2 spell, not level 1.

In any case, the limit is on how many *racial* HD you can gain by turning into your new race. Your *total* HD includes class levels, which do not change with alter self. The Raptoran ability here clearly is talking about total HD, not racial HD, since the majority of Raptoran PCs are going to be advancing by classes (becoming a Raptoran Fighter or Raptoran Ranger or whatever).

Not incompatible. Just not Rules As Written.

Alter self is a level 2 spell, not level 1.

Well, that's an embarrassing mistake. Still, it stops advancing in anything but duration after CL 5.

Well, yeah. That's why people proposed Raptoran in the first place -- ISTR they're an LA +0, 0 racial HD race.
