Ok, lets say my wizard creates a staff. As he lv's could he add newer spells and abilities to the staff?

Yes. From the SRD...

"A creator can add new magical abilities to a magic item with no restrictions."

...or see page 288 of the DMG.

Excellent. I wasnt sure if you could still do that in 3.5.

Thanks

What if you are not the creator. Can you only add to a magic item you created.

Second, you are not creating a magic item, you are expanding one. Do you have to have the make staff feat, to add a ability to a staff?

I can't find this anywhere.

Thank You,

You don't have to be the creator.

You still have to meet the prerequisites of the item.
