....magic weapons get a will save.......an item in a creature's possession uses its will save or the wielder's. Does this mean nonmagical items get will save also if they are held? If they do then why would it state that magical items get a will save. If the magical item doesn't have intelligence then how does it get a will save if they are not held?

The backbiter spell targets the weapon. The weapon could be wielded by a creature or not wielded by a creature when it is targeted. Use the following guidelines for determining the saving throw, if any, to use:

1. Magic items always get a saving throw, whether or not it is being wielded at the time. A magic item's saving throws are 2 + 1/2 its caster level. (An intelligent magic item also adds its Wisdom Modifier to its will save.) Generally, a weapon's caster level is 3x its enhancement bonus. Specific weapons have specific caster level's as listed in the DMG. Special properties have minimum caster level's as well, but it can be a pain figuring up which one is highest or what not. Examples: a +3 longsword has a caster level of 9 and saving throws of +5. A +3 holy longsword has the same, since the holy enchantment requires only a caster level of 7. A +3 brilliant energy longsword has a caster level of 16 and saving throws of +10 since brilliant energy requires a cl of 16. A Holy Avenger has a caster level of 18 and thus has saving throws of +11.

2. Non magic weapons get a saving throw only if they are being wielded by a creature at the time. If they are not being wielded, backbiter affects them automatically since they don't get a save. If a creature then picks up the weapon and tries to attack with it, the weapon will attack the wielder.

3. A weapon that is being wielded at the time will use the wielder's saving throw, or if its a magic item it can use its own saving throw if it is better than its wielder's. A powerful magic weapon might very well have a better will save than the fighter thats wielding it.
