OK, this is a spell I came up with while thinking up the culture for a particular character I wrote up. This was a side thing that isn't really tied to him at the moment, though he may learn it when he gets to a high enough level to cast it. The name is similar to Banishment, but it's effect is more like that of Sanctuary.

Banish
Abjuration (Lawful)
Level: Clr 5
Components: V, S, Special (see text)
Casting Time: 10 minutes
Range: Touch
Target: Creature touched
Duration: Permanent
Saving Throw: No
Spell Resistance: None

This spell is utilized whenever someone has committed a crime against a nation, organized religion, or sufficiently powerful individual of a great nature. Upon casting this spell, the caster decrees an area. This area must be a minimum of one square mile in area, and must be clearly defined in terms of physical borders (a particular mountain range, for example), or distance/political limitations (The Kingdom of Anywhere). In case of a distance decision, the central location must be stationary (Not to come within 50 miles of the Pillars of Law, eg). The subject of this spell is forbidden from entering the area determined by the caster. If cast within this area, the spell remains dormant until he leaves the defined area, at which point it activates normally. If he, at a later date, willingly attempts to enter the area, he must make a Will save, DC 10 plus the caster level of the individual who cast the spell on him. If he fails, his body refuses to enter the area, but he is otherwise unaffected. If he succeeds on his Will save, he may enter the region, but the person who cast the spell is instantly aware of the violation, and where it occurred at. This spell does not give the caster knowledge of where the individual is at any given time, simply where he was when he broke his Banished effect. While in an area an individual has been Banished from, they take a -4 penalty on all rolls made.
Banish can be dispelled normally, however the one attempting to dispel it must make a caster level check against a DC of 10 plus the caster level of the individual who cast the Banish spell, in place of the normal dispel check. Successful dispelling of this spell is alerted to the caster in the same way as a willful violation of their banishment.

Legal Component: To be able to cast this spell, the target must either have committed, or been found guilty of some crime of sufficient magnitude to warrent banishment. Traditional examples include treason against the crown, or blasphemy against a church, but these are hardly the only possibilities.
Special: The verbal component for spell concludes with a listing of the various crimes the target creature has committed and/or been found guilty of, and the punishment for said crimes being banishment from (insert location here).

Most of my questions are for general clarification. Your game/game world may not need the extra considerations.

What happens if the target creature is banished while still within the territory defined by the banishment spell?

What determines a clear political border? Any crazy person with a stronghold can declare himself emperor of a region, but that doesn't make him a real ruler; but if that person truly believes he's the ruler, is that enough for the spell to work?

What happens if the original territory defined in the spell is changed; expands, loses land, disappears? For example, Bob the Badguy is banished from the Kingdom of Whateverland. If Whateverland expands it's borders does that expand the territory Bob cannot enter, of will the spell "remember" the original borders?

Does the spell end if the original caster dies or will there simply be no alert issued should the target choose to reenter the territory following the death of the caster?

Banish can be dispelled normally, however the one attempting to dispel it must make a caster level check against a DC of 10 plus the caster level of the individual who cast the Banish spell.

Is this in addition to the dispel check? What happens if this check fails but the dispel check succeeds, is the spell still active?

You may want to consider adding [Lawful] to the spell descriptor.

I would make the casting time longer, 10 minutes or more probably. This spell is most likely reserved for special circumstances and casting it should be time consuming enough to make the importance of the spell clear to all who witness it being cast. A couple hand gestures and some brief words hardly seem grandiose enough for this effect.

I would note that the verbal components include a reading of the crimes committed.

Added in that. Typically, as soon as the spell is cast, they are forcibly escorted out of the area, so as to activate the spell as soon as possible.

What determines a clear political border? Any crazy person with a stronghold can declare himself emperor of a region, but that doesn't make him a real ruler; but if that person truly believes he's the ruler, is that enough for the spell to work?

Added specifics in that will hopefully clear that up.

If Whateverland expands it's borders does that expand the territory Bob cannot enter, of will the spell "remember" the original borders?

It goes off the current borders, though if it expands to an area they are already in, it goes dormant again until they leave the new territory.

Does the spell end if the original caster dies or will there simply be no alert issued should the target choose to reenter the territory following the death of the caster?

No, it doesn't end until the target dies. Yes, if the caster dies, there will be no alert about the violation, but the subject will still have the -4 penalty on everything he tries to do, as the spell does everything to hinder him long enough for the authorities to locate and capture him.
