Couple of spell issues that keep coming up in my group and I was hoping people could provide some input!
1. The Complete Divine Spell Miasma - there is no save allowed! Does this mean a subject is instantly taken out of the fight and eventually will die no matter what?

2. Does Protection from Evil negate any spell that has the Enchantment or Mind-Affecting subtype?

3. Do spell effects linger even after a character who casted them dies? and on a related matter, can a caster dismiss the effects of an ongoing spell at any time?

That last one is one that keeps coming up and im not sure how other groups play it out!

Thanks in advance

1) There are some spells in the Complete X series of books that exist for the sole purpose of tripping up DMs. Congratulations, you just found one. (Also see: the orb spells in Complete Arcane. And all the other damage-dealing "conjurations.")

(OK, there has since been errata for Complete Divine stating that miasma should allow a Fort save to negate. You can decide for yourself whether this makes everything OK.)

2) This is a little more subtle. First of all, protection from evil (or whatever other alignment) does not negate an effect (you can still dominate a protected creature), it just prevents mental control from being exercised as long as the protection lasts.

It only works on Enchantment spells which have the (Charm) or (Compulsion) descriptors, and it only blocks the active exercise of mental control. A charmed person under protection from evil would be immune to Charisma checks to get him to do something he wouldn't otherwise do, but he will still feel friendly to the person who charmed him.

3) Spell effects last until their duration runs out, they are dismissed, or dispelled. (Exception: a summoned creature's effects disappear when it does, either because its summoned form is killed/destroyed, or because the summoning spell expires.)

A caster can only dismiss a spell if it has the (D) notation in the duration; doing so is a standard action. If the spell doesn't have the (D) notation, a caster can always use dispel magic to get rid of his own spell (dispel checks are automatically successful against your own magic).

The Complete Divine Erratta changes this to Fortitude Negates.

Although I appreciate the answers to the questions given, something is still a little unclear to me and it comes up fairly often.

If a character casts a spell then dies in combat, does the spell persist? clearly something with permenant in its duration does. By the same token, something that has concentration as a prerequisite to being maintained would dissipate. What about other spells like say entangle that lasts a certain numbre of rounds with the [D] option?

I was thinking a spell with the [D] option would dissipate upon death but not a spell without that option. What do you think?
