So the spell flight .. be made permanent, as with the permanency spell?

Its up to the DM. Provided your DM aproves, you can research a version of permanency that also affects the fly spell.

I think you would be much better off with a permenent, slotless item that grants flight.

What permanent slotless item grants flight?

you can double the price of any sloted item to make it slotless.

I wouldn't be able to take the feat Flyby Attack, if an item was giving me Flight. Don't I need to be able to fly on my own?

(I suppose though, the same item could give me the Flyby Attack feat in addition to Flight...)

You can't take flyby attack if you're merely enchanted to be able to fly, either.

Technically if you just enchant yourself to fly you aren't flying on your own then.

There is a feat in the Races of the Wild book that allows you to take flying feats normally limited to natural flyers. Your DM might just let you take such feats anyway if you can already fly on your own at any time though.

They're right, to be able to take Flyby Attack, you have to be able to fly on your own. That means no help from items, no help from magic spells. You gotta be be able to fly naturally.

There is a feat (I think its in Races of the Wild) that allows you to qualify for other feats as if you had a natural fly speed, regardless of the source of your flight. If I'm not mistaken, its called natural flyer.

It's Born Flyer from Races of Wild

Well.. what about a Warlock - who has a spell like ability to enable him to fly for 24 hours.

I can see the difference between a caster - who casts a spell on himself, but this is someone who just effectively 'Wills' himself to fly.

Aside from that, I can also see a difference from someone who has had a Permanent Fly applied to him.

(Yea Yea .. ask DM .. blah blah ... I just like arguing.)
