I am an old school roleplayer in which you could only teleport items with in your grasp that you could theoretically carry (ie less then you'r max load in weight). But the new rules state that you can teleport up to 1 willing medium sized creatures for every three level of the caster. Does this mean that you can not teleport a sleeping character or an unconsious character, or say even a surprised character that would be unwilling if they knew your intentions. And if the NPC or player knows your intention and doesn't want to be teleported does this mean that they have to try to save or does the spell just not work.

Any Sited help will be much appreciated seeing as my DM is a stickler for the written rule.

Honestly you can make your ruling on it... I have no idea where to find it.

My best guess is if they are unable to make a willsave then you can do it to them all you want, and thus sleeping counts.

There are tons of exceptions in the books including Teleportation traps.

Sleeping characters get a Will save against spells and magical effects as normal, but are considered to have voluntarily forgone their Will save when the save is marked harmless. For instance, if you try to cast Inflict Light Wounds on a sleeping creature, they get a save as normal. If you cast Fly, however, they are treated as giving up their save and are automatically affected.

Have a look in PH chapter 10, about page 177 (don't have PH to hand at the moment). "Willing" might also be in the index.

"harmless" and "willing" are different. "harmless" means that the subject doesn't get a save unless they explicitly want one. "Willing" means that the subject must actually want the spell to take effect (no save, it just fails to affect them). There is an exception in that unconscious creatures are automatically considered willing.

So you can always teleport a sleeping or otherwise unconscious character, even if they would resist if they were awake. You cannot teleport a stunned, flat-footed or otherwise at least partly awake character if they don't want to go. Note that being stunned doesn't completely prevent you from being aware, just from taking actions. A stunned character can be "willing" or not as they choose.

I always thought unwilling targets were allowed a will save to resist being teleported......

No, they just resist it successfully without needing the save.
