Is there anyway a Wizard could cast a divine spell on a scroll from a cleric?

And is there anyway that a Wizard could cast an Arcane spell on a scroll thats a higher level then himself? (Ex. Casting a Fireball from a scroll if the wizard is only 4th level.)

My friend is arguing with me that his Wizard has been doing this for a while and scrolls are the ultimate abusive tool and I don't think I've ever read this rule up before but I just wanted some clarity as if this is some house rule bull(*#$ he's making up or if I've been overlooking something for a few years now with 3rd edition D&D

An arcane caster can only cast a Divine scroll IF they make a Use Magic Device Check.

From the SRD:
Activate the Spell: Activating a scroll requires reading the spell from the scroll. The character must be able to see and read the writing on the scroll. Activating a scroll spell requires no material components or focus. (The creator of the scroll provided these when scribing the scroll.) Note that some spells are effective only when cast on an item or items. In such a case, the scroll user must provide the item when activating the spell. Activating a scroll spell is subject to disruption just as casting a normally prepared spell would be. Using a scroll is like casting a spell for purposes of arcane spell failure chance.
To have any chance of activating a scroll spell, the scroll user must meet the following requirements.
• The spell must be of the correct type (arcane or divine). Arcane spellcasters (wizards, sorcerers, and bards) can only use scrolls containing arcane spells, and divine spellcasters (clerics, druids, paladins, and rangers) can only use scrolls containing divine spells. (The type of scroll a character creates is also determined by his or her class.)
• The user must have the spell on his or her class list.
• The user must have the requisite ability score.
If the user meets all the requirements noted above, and her caster level is at least equal to the spell’s caster level, she can automatically activate the spell without a check. If she meets all three requirements but her own caster level is lower than the scroll spell’s caster level, then she has to make a caster level check (DC = scroll’s caster level + 1) to cast the spell successfully. If she fails, she must make a DC 5 Wisdom check to avoid a mishap (see Scroll Mishaps, below). A natural roll of 1 always fails, whatever the modifiers.

Holy monkey (*#$, so you could cast animate dead from a scroll if you were only second level Wizard!

yes, provided that you made the caster level check, and that the scroll was created by a fellow wizard or sorcerer... you could NOT cast an animate dead spell from a scroll made by a cleric.

you could NOT cast an animate dead spell from a scroll made by a cleric.Yes you can. Again, using UMD. Not the easiest of tasks at second level, but possible.

why are you clouding the question... he was not asking about Use Magic Device...

besides the DC for using the divine animated dead scroll (assuming it was scribed at mimimum caster level) would be 25... a 2nd level wizard has a maximum of 2.5 ranks in UMD... so it is entrily unlikly that the wizard would beable to activate it (I don't see many 2nd level wizards out there with an 18 charisma)...

why are you clouding the question... he was not asking about Use Magic Device...He asked if he could use a divine scroll of aniamte dead. The answer is yes -- but only with UMD. Whether a wizard is likely to succeed or not is dependent upon a very specific set of circumstances, but it can be done.(I don't see many 2nd level wizards out there with an 18 charisma)...But plenty of sorcerers in too many campaigns. (And probably a few too many wizards, based on the uber-munchkin stats floating around over on the Optimization and Art Request boards!)

Not a build that I would recommend... {maybe if aiming for wild mage}, but it is possible if you are really dedicated to being able to use any magic item. Of course Bard, Rogue or Warlock would be better choices.
