Why would a level 1 character/monster (no humanoid levels or ecl) be a cr 1, how does 1 1st level character provide a challenge to an average party of 4 1st level characters

A CR 1 creature should have a party of 4 1st level character spend about 20% of their resources in order to defeat it. That's how the CR system is set up. The CR 1 creature should not be a 50/50 encounter.

If you want an equal-level challenge, that's CR (or EL) equal to party level +4. Be aware, however, that this could easily kill off one or more PCs...it's a roughly even fight, after all.

Most encounters shouldn't have a high chance of killing the PCs anyway, and that is even more true at low levels where death is hard to overcome. If a normal encounter had a 50% chance of TPK, I guess I wouldn't play D&D but some video game where you merely start back a few miles behind each time you die.
