A loud, horrible shreik emits from around the corner as a figure moves into sight. Infront of you stands a hunched over mass of almost invisible, blood-stained rags. You only see two of the most bone-chilling eyes that have ever laid upon you. It raises its long, spider-like fingers towards you and steps forward. It seems to tremble with an almost eternal fear.

Figments are what is released in truely fearful moments of life. The person experiencing this event is in such a dire, life-threatening state of fear, that they unknowningly release a little bit of them into the world. This leaves the person physically and emotionally drained forever. This small portion is continually experiencing the fear from the moment it broke off from the person. It wanders the world, looking for ways to cease its own existence. Over time, the one's that still live, realize that when others become fearful because of them, they lose some of their continous fear.
Instead of killing people, they try to completely immobilze them. Figments attempt to make someone a shiveled shell of what they were. Even though they can inflict small amounts of pain, with each touch, they drain away more of the person's self and abilities. Figments can also instill into someone the same primal fear that released them in the first place, which can release another. Only one Figment can be released per person. If the Figment dies though, it releases all the drained away elements back to their owner's. Figments do not breath, eat, or sleep.

Combat:
A Figment will immediately engage in combat, even without being provoked. They deal next to nothing for damage, but instead, prefer to drain away the strongest parts of a character.

Create Spawn: If a character is already in some state of fear, a Figment may attempt to scare them more and release another Figment. The character they are targetting must then make a Will save (DC 15) or else they increase one level of fear.(Shaken to Frightened, Frightened to Panicked) If the save fails, another Figment is spawned adjacent to the character being targetted.

Ability Drain(Ex): Whenever a Figment deals any damage to a character, that character's highest ability becomes drained by 2 points. A constitution score cannot be reduced below 1 with this ability. If a Figment dies, all abilities that were drained are returned to normal.

Frightful Presence(Ex): Whenever a characher hears or sees a Figment, they must make a Will save (DC 12) or become frightened.

Magical beasts have d10 HD. Should be 5d10+10 (37 hp)

Initiative: +4

Should be +6 (+2 Dex, +4 Improved Init)

This is odd. Why does the speed end in a 5 instead of a 0? There's no rule against it, but I've never seen a speed ending in a 5 before. I recommend changing it to 40'

Where does the +1 deflection modifier come from?

First, is this a "touch attack" (that is, ignoring armor), or more like a claw? (if it's a touch attack, it needs to say "touch +7 melee touch"
Second, I don't think you get your Strength mod on an attack that deals no damage.
Third, what kind of damage is this? Negative energy? Slashing? Random, generic damage?

For a 5 HD magical beast with a 2 Int, you've got 8 skill points. After subtracting for stat mods, you've used 17. Either up Int to 10 (and drop 1 skill point) or rearrange your skills.

Feats: Improved Initiative, Diehard, Iron Will

5 HD = 2 feats. If one of these is a bonus feat, it should be so noted with a (B). Diehard has Endurance as a prerequisite, unless it is a bonus feat.

I really like the description!

I like this! It's cool. However, the Will Dc is wrong; it should be 10 + 1/2 Hd + Cha modifier, or 12. I suggest upping the Cha to 16-17 (save DC 15).

Why the character's highest ability? As a master of fear, I would think a figment would drain either Wisdom or Charisma?
Also, you might consider dropping the "abilities restored when the monster dies" bit and making it ability damage (which heals over time) instead of drain (which doesn't).

Frightful Presence(Ex): Whenever a characher hears or sees a Figment, they must make a Will save (DC 12) or become frightened.

Technically, frightful presence takes effect when a monster charges, attacks, or does something equally dramatic (such as screeching).

All in all, a very interesting creature. I'm not sure about the magical beast type, though; this looks more like an undead, fey or even outsider to me. I'd push for fey; there aren't enough nasty, scary fey out there.
