from the SRD: The spell also allows the subject to move and attack normally while underwater, even with slashing weapons such as axes and swords or with bludgeoning weapons such as flails, hammers, and maces, provided that the weapon is wielded in the hand rather than hurled. The freedom of movement spell does not, however, allow water breathing.

I kinda take this to mean that you could walk along the bottom or swim un-impeded. The spell is designed to allow you to move freely, so i don't impose penalties in the water, but it has come up so rarely, and it never mattered too terribly. I am going to say they could walk normally along the bottom, but to swim they would have to make swim checks just as though they were wearing armor, so a warrior/cleric would still have to make those checks, which might prove difficult.

as for the weapons thing, that is just awesome, and anomolous, i just add it up to the spell doing variable things than the all encompassing name gives it credit for. Technically it should be named: Roger's amazing garb of magical hindrance dispelling, escape artistry, & underwater attacking

They can still swim, tho movement doesn't require a swim check.

yes but what would be the speed of the character would it be the normal speed of a person swimming, or would it be the person base speed.

Personally, I'd give him his land speed or fly speed whichever is better (including all the bonuses to speed).

i would allow land speed to be regular, fly speed is interesting, but i would also allow it to be regular...

however, swim speed would still be a check and whatever their base is, the FoM doesn't allow for a faster swim, just a normal swim... whatever that means. hehe

We have ruled that underwater a person can swim if they want to (too far from the bottom to walk on the bottom where they could use their normal land speed for example) and that doing so they use their swim speed and that they simply suffer no armor check or other penalties while doing so.

Personally its what makes more sense since their is already water walk which allow you to walk above
and FoM is intended to negate penalty not to had you movement mode
like in a sandstorm you could get under than sand but would you gain burrow speed? Guess you would have to "Swim" or walk up your way out if your not crushed by pressure but you would certainly not gain burrow speed
