From what I gather from Unearthed Arcana, it seems there is no way to regain your action points once you've used them. I suggest a variant to regain action points at a slow rate, but regain them nonetheless. Perhaps if you regained 1 action point per level per month? Year? I don't think it would unbalance the game at that pace, but it might make players more willing to use their points before they die and no longer have use of them...

Well, since characters gain action points at every level- and the amount they gain increases every level as well- this would seem to handle the regeneration portion of the action points. A character shuld be trying to spend their allotment of action points by the time they gain their next level since they will gain more then.

If you really want to encourage spending action points, go away from the over generous route. Say that every time they gain a level, their action points are reset to whatever they are supposed to gain for that level. This would encourage them to spend their action points by the time they hit their next level so they won't be wasted.

If you are looking for a bit more action-y game, try what Spycraft does and regenerate the action points every *session*. However, I'd also give less action points (2 + 1 per 4 levels or something). This is really fun, actually, since it encourages people to use their action points during each session. You'll get more of a cinematic feel out of the game, but my players liked it a lot. More daring-do and long-shot attempts at goals.

I use Cha + 1 at 2nd level and every 3 levels after that per session. It makes Charisma worthwhile, and not so much of a dump stat. For example, a Cha 6 Dwarf fighter wouldn't get an action point until level 8, while a Cha 18 sorcerer would have 7 action points by then.

Mutants & Masterminds also uses a similar system, although they're called "Hero Points".
1 Hero Point at 1st level.
+1 Hero Point every odd level.
Hero Points regenerate at the begining of each adventure (or sooner at the GM's option, in the case of really long adventures).
Hero's Luck feat. +1 Hero Point. Can be taken multiple times. Hero Points cannot exceed your level.

You could always award bonus action points between levels for heroic behaviour (or exceptional roleplaying). This isn't quite the same as regenerating, but forms a nice compromise.
