1. You describe the BBEG's black armor and he goes "Cool! Dibs."
2. He silences a witness to a crime whose version of things differs from his with a backhand.
3. When the town guard tell him he needs to surrender his sword, he shouts "What? No, I will not give you my sword!" When they insist he is breaking the law and must surrender it, he shouts "Break the Law? I AM THE LAW!"
4. He considers his Evildar to be liscence to dispense summary justice.
5. When told of a goblin village by the scouts, the first thing he shouts is "Let's do the villiage! Let's do the whole <bleep>ing villiage!"
6. He confiscates all charity money, citing "They'll only squander it on useless things anyway."
7. His war-cry is "Blood for the Blood God! Skulls for the Skull Throne!"
8. He erects a totem to the Blood God. Decorates it with skulls and corpses.
9. He backhands every commoner who dosen't agree to everything he says instantly.
10. He has his gauntlet spiked on the top of his knuckles, so as to make his backhands maim.
11. Four words: "Skill Focus (Profession (Torturer))"
12. He excercizes jus primae noctis. Only he decrees it dosen't apply only on a maiden's wedding night. Or only to maidens.... Or that it applies to noblegirls, too.
13. He quotes Niccolo Machiavelli or Napolean Bonaparte. Constantly.
14. The Barbarian has to restrain him in brawls.

Hmm... 1,3,4,5,7,13, and 14 all apply to an elvish paladin (raised by orcs) I played once. I might have kind of based his code of honor on 'The 7 habits of highly effective pirates.'

I think it may well be the only elf ever rolled up who took the feat Exotic Weapon Proficency (Orc Double-Axe).

17. He spends half of his wealth-by-level to get his armor cleaned from the blood of his victims
18. He doesn't cares that his armor is full of blood and spends the money on torture devices
19. He call his followers "The paladin version of the spell 'Find traps'"

I actually DMed a monk who did all these things:

20) He tries to stitch unconcious kobolds, orcs, gnomes and goblins to his skin, then acts confused when heavenly voices say 'That's really a bad idea.'

21) He picks up the dead (or unconcious) bodies of allies to 'find traps.'

22) He actually qualifies (in every respect but the 'LG' on his Sheet) for the Assasin PrC. Yes, he does. Yes, I know about the special requirements.

23) The tiefling rogue who is already an Assasin thinks of him as a role model.

24) When the gods meteor swarm him for doing all of the above, he starts trying to explain that a code of honor is 'really just guidlines and suggestions anyway, so I'm still LG!'

27) He begins seeking out texts on becoming a Blackguard while trying to get as many paladin levels as possible before his switch.
28) He uses 'Detect Evil' on every person and creature he encounters (including animals) in hopes he can find something to slay.
29) Foes slain by him often find themselves stabilized by his 'Lay on Hands' only to be Coup De Grace in a brutal way.

Edit: Updated to fix the numbers since Mel got his post in about the same time as me. Though I can't help but notice his and my first one are rather similar...lol.

30) He has seriously considered losing to a vampire in order to gain its benefits.
31) He has threatened to kill his party member because he was out of healing spells and wanted to put him out of his misery (and still wanted XP for the kill)
32) Forget the horse; I'm going to dispense justice from the back of a Black Dragon
TheChilliGod

33) "Pelor? Pfft, what a wimp. 'Heal the people!' You do know that his worshippers are half-begging to be stomped on by the real deities. Like, say, Hextor.

34) The paladin is actually interested in the motives behind the Evil Dude Whom He Wishes To Kill, and takes them into consideration himself.

35) The paladin considers the devil's offer of lots of money for his eternal soul... seriously.

36) "Tell me right this <bleep>in' instant where the assassin went, or I'll rend both your wife and your child limb from limb with my bare hands!"
*After finding said assassin*
"You did a marvelous job of killing that maiden back there."

(Yeah, #36 actually happened. At least it wasn't a paladin who said it, but still, the party paladin was, like, right next door.)

I was going to run a Paladin once who wore spiked black evil-looking armour. The idea was that wearing black, intimidating armour is in fact not an evil act, so he just does it because "it looks cool". He was the nicest guy you'd ever meet, but seen initially he looked like he had just come forth from the Abyss itself.

I didn't end up running him because there was already a Warblade and a Ranger in the party, but he's on the bench for a later game.

39) When moving through an evil temple at night, walks up the the naked, sleeping, evil priestess, and puts his sword through both her and the bed as she's asleep. When questioned about this, he shrugs and says "She was evil, so what?"

Happened in an actual campaign I was a part of. The worst part is the DM didn't even take him to task on it, despite four out of five players (the fifth being the paladin in question) saying otherwise.

Better yet, let her escape.

No, in my game if a Paladin PC came across a sleeping bad guy, woke him up for honorable combat and the BBEG used it to escape and wreck more haovc, that Paladin would be stripped for foolishness and letting real evil kill more innocents.

46) He is always gallant, romantic, and chivalrous in his interactions with his girlfriend, partially because he's afraid that she'll energy drain him with her kiss if he gets her mad at him.

47) He wants to find a way to "turn off" the empathic link with his mount, because he's sick of the constant feelings of distress, horror, and moral outrage that keep coming from his mount's mind.

48) "Y'know? I just realized that this whole class is weak, and my levels in it are wasted. Well, at least I have enough wisdom to be a passable druid. Hmm... a pity there aren't any Unearthed Arcana paladin variants for paladins with neutral alignments. Ah well."

49) "Damn! Do I really have to multiclass into ninja to get poison use?"

50) "So if I'm a hound archon, I retain the [lawful] and [good] subtypes regardless of my actual alignment, right? So I'd still qualify for the paladin class regardless of my real alignment since I'm treated as lawful good for the purpose of game effects, right?"

Depends on whether you're willing to ignore your code of conduct that says you have to fight honourably.

I've never considered killing someone in their sleep honourable, but of course one's milage may vary.
In my opinion killing a sleeping cultist in cold blood wouldn't cause him to fall, but I'd put a mark on his record... eventually he'll fall if he doesn't learn how to behave.

Killing someone like that is MURDER
Murder = EVIL

Actually, people bandy about the word murder like they think the definition is something along the lines of, "Killing people in a way that makes me feel icky."

That's not the definition of murder.

Murder is distinguished from other forms of willful killing of human beings by its association with Malice and / or Criminality. If you have a righteous mandate to end the life of another person (such as a Paladin does), killing them in fulfillment of such a duty is not murder in the eyes of the Paladin's order. Whether you kill them in honorable combat or asleep in their bed does not impact the act on the Good-Evil scale, only the Lawful-Chaotic scale.

This is why Grey Guards are distinguished from Paladins in conducting acts like this one. Grey Guards get to violate their Code of Conduct and Lawful alignment for the sake of Good.

There were much beter ways to deal with that
1 being knocking her out
Tie her up and and gag her being 2

No. She was condemned to death for her wicked actions. Her life was forfeit. Bringing her back for an orderly execution doesn't change the actual outcome.

Moreover, such indulgences introduce unnecessary risk to the equation. Instead of worrying about wards, meta-magic feats, and the like you end her.

Killing evil isn't justice, fighting it is.

A lot of the time "defeating the Evil doer for good" translates into, "making sure the Evil doer is dead and stays that way."

It isn't always the case, but more often than not such a circumstance is why they sent a trained killer to handle the job rather than a guidance councilor.

63) Has suddenly taken an interest in concealing himself from evildoers' sight, even though learning this ability is cross-class. Has picked up the odd habit of smashing his enemies' weapons instead of simply disarming them. Continuously "double dog dares" the wizard to summon some kind of demon or devil "just to see if he really can."

64) Walks into a room of noncombatant orc babies, children, elderly, infirm etc. (No matter what he chooses to do next, it's Fall from Grace time, if the 4325498759832749852074 paladin threads are any indication.)

65) Does not own (and use) a phylactery of faithfulness. Why does the hypothetical existance of prison cells make a difference? - if prisons were even used for more than storing away prisoners while preparing punishment.

mlund makes a great point about how people often define murder. Waking her then killing her would be just as much murder. Otherwise this was simply ambush.

73) When he is trying to use the "if the victim is evil then the act is always OK" argument along with "The inverse of an evil act is always good" to basically do whatever he wants then justify it with semantics after the fact.

See how well this works: Raping a good woman is evil, so raping an evil one must be good (sorry, evil in all cases). Coercing a good person by torturing or murdering his friends and family (individuals of any alignment) is an evil act, therefore, doing the same to an evil person is a good act. Sorry again, but simply playing out morality like you are filling in the blanks of a Mad Lib doesn't make you a good guy.
