First of all, Challenge Rating (CR) has nothing to with Character Level.

From there, you need to first create the base construct; Incarnate Constructs are based almost entirely on their base construct. For the sake of argument, we'll go with a standard Clay Golem (http://www.d20srd.org/srd/monsters/golem.htm#clayGolem).

Make a note of the relevant steps in Savage Species and simply walk through the conversion process. A standard clay golem turns into a Large-sized creature with 9d8 hit dice, but an Effective Character Level of 7 (-2 LA). It possesses no skills, no feats, no class levels, no special attacks, and no special qualities. CON and INT must be determined normally. From this point on it may gain experience as a living creature, gaining class levels (along with feats and skill points) using the standard rules for level-adjusted creatures with racial hit dice.

You'll need to be high enough level to have an ECL 7 cohort if you choose to use a standard clay golem.

The spell Incarnate Construct turns a non-living golem into a living creature. Since the berserking nature of clay golems is the direct result of the animating "elemental spirit" breaking free, I'm going to say yes, the former golem no longer risks going berserk.

Edit: however, if you like the flavor you can always take levels of barbarian. Rage isn't quite the same thing (thankfully!) but it makes for good flavor!
