I play a 16th level lawful neutral monk in a group with a priest of sune (chaotic good) and a rogue, who actually is an assasin (NE). I know of his prestige class as a person but not as a player - even though he has done things that has made my monk seriously suspicious of his intentions.

In this case the group was walking down the street (me taking the rear) when a monk-like person appeared out of nowhere handed me a small bag and said "look out for this for me iŽll be back for it" and disappeared.

I must ad that we already lost one party member in this city (a city that values justice above all other things, because it makes trade safe) due to false planted evidence of a murder he did not willingly commit.

We all agree to have nothing to do with this bag and took it to the guardhouse, here they took our statements and identified the content of the bag; a ring of 3 wishes, a cloak of protection +5 and potion or bottle of the genie. after this the guards took it into custody.

Next morning we meet at our inn for breakfast, and the rogue (obviously having second thoughts about the bag knowing the content) presents the bag, saying that we dont need to worry where he got it from as long as its back. Being faster and stronger i wrestle the bag from his hands and run for the guard house to return the stolen goods. I know he can't follow me when i start to move fast and i dont want a confrontation right now, i just loose him by sheer speed.

I will return the bag to the guards, but i will not give up his name.

Sooner or later i fear he will attack when the sitation is to his advantage, but i do not wish to land the first blow only on that hunch, what would you do ?

Emphasis mine.

Give him up to the local guard for his crimes. He stole the bag (or at least, was in possession of stolen property), and should be tried and punished for it.

If your character does not feel he can trust the other character, then you need to have an in-game discussion about it. Maybe this can be resolved (the Rogue can stop stealing things, or at least hide it from you better), or not. Your Monk may very well leave the party, or force the Rogue out. Such is the dynamic of a group when someone decides to do things of which another party member disapproves.

Killing a party member is not the only way to deal with his recurring infractions, or your suspicions. Sometimes, you can get him to change his behavior, ask him to leave, or have him arrested for a crime you saw him commit. If he refuses to leave, or resists arrest, then a fight would probably ensue.

Perhaps talking to the player about his character's behavior might head off the need for him or you to leave. Maybe he just needs to know to hide it from your character, or your character will haul him off to jail.
