I want the boss of the next dungeon to be an actual character as opposed to something out of the monster manual. If theyre fighting the boss solo, how much higher level then the party should he be? How high stats should I use? How can I make it a challanging, boss worthy fight without it killing them?

Assuming you're playing 4th edition, trying to make a challenging fight against a lone PC is a recipe for disaster.  Depending on how the first couple dice rolls go, one of two things will happen.  Your Villain will die in one or two PC turns, or he'll TPK them.  It's almost impossible to make a compelling boss fight in this manner.

If you want to make a solo villain that works like a PC do this:

1) Create a PC equal to or a couple levels above the PCs
2) Create a solo monster at the encounter level and role (skirmisher, soldier, controller) you want, or pull one from the monster manual
3) Take the HP, defenses, etc from the solo monster.  Delete the powers.
4) Take the powers from the PC.  At-wills are minor actions.  Encounters are recharge powers, standard actions.  Dailies are Encounter powers, standard actions.  Give him a couple interrupts to make sure he has enough actions to survive as a solo.  Adjust damage on powers to be in-line with other solos of the same level.
