Quick Question: Dragonmarks

The character creation guide says you can use everything in the Ebberon CG "Except Dragonmarked rules and backgrounds." Does this mean I can't use the feats at all? Or just the specialised rules for dragonmarks and their backgrounds?

You cannot use any rules item that requires or relates to a dragonmark, including any feats that grant a dragonmark or the use of a dragonmark or any feat, paragon path, or other that requires a dragonmark.

I notice a distinct lack of the phrase "dragonshard" in that rule. Does that mean my Tiefling can use a Kyber Shard of the Firey Depth on his Flaming Weapon?

Yes, dragonshards are legal items.
