At that point the cat is Both & Neither alive and or nor dead, it takes an observer to fix a status, and since Chuck is the only observer he can declare it Dead. Actually, that kitty would be perfect to use in the Readied Action Armoir Initiative Trap (armuir... armwar.... armoiux? armnoir???? stupid foreign wardrobe)
