Anime declared child porn, Virginia Man gets 20 years

Certainly he was into actual bad stuff, and probably deserves to be publicly lynched. Still Anime is culturally significant - as much so as the events (use of Nuclear weapons on civilian populace) that shaped the culture that created it.

What brand of drum are you going to bury your Anime Collection under the Chicken shed in case this becomes a ban on all Japanese Anime?

None, as none of my anime is child porn.

Neither is mine but the decision wont be left to you or me...it will be left to a minority interest who would never get elected by either of us, have no problem with carpet bombing third world countries filled with women and children, and probably have Bugs Bunny in a dress at the back of their closet.

Thats a though: I wonder if it is possible to charge the US Government with child Abuse laws protecting kids from destruction for killing children abroad.

So ... umm ... what non-child porn related reasons would a person have to create or view anime child porn? See, I doubt that any normal anime viewer needs to be concerned. Cuz, you know, they likely aren't into the anime that also happens to be child porn. Kind of like a lot of us are into porn, but not kiddie porn. ;) Just because anime kiddie porn was used to prosecute someone the same way regular ol' kiddie porn was does not mean that anime is suddenly going to be mass banned or used to prosecute its viewers. Cuz regular anime isn't kiddie porn. I know I'm repeating myself here, but I can't think of anything else to do. It's simply mind-boggling that anyone would somehow link anime kiddie porn used in a conviction to some potential anti-anime witch hunt. Really. Jeebus.

Not to say that regular anime viewers shouldn't be hunted down and prosecuted, of course. The thing is, we don't have any laws against bad taste on the books right now. ;) :P

EDIT: Posted this as the post above mine was being written. I get it now. It's just a lame excuse to rant about the gov't. Lame-o. I give this thread zero stars. Suck on that, nutjobs! Oh, almost forgot! *re-adjusts tin-foil hat* You'll never get me you bastards!

Except that under this new ruling, Astroboy would be deemed Porn because the the depiction of the Destruction of Astroboy's little 12 year old sister would qualify as offensive.
For those with Bubblegum Crisis: Maki sees his sister naked (getting into a combat suit). Even the aluded to sexiualization would be qualified thusly.

Basically the bar of Censorship as to what Anime qualifies and what is 'safe' is now determined not by a federal government body reviewing books, Movies, Comics, Television, and games, but rather by a local area court case. Now your local church has a say in what is acceptable.

Did you read the article? It was pretty clearly talking about h-loli anime not just your run of the mill anime. If you just avoid the h-anime, you should be fine.

But that isn't the representation of the sexual abuse of a child therefore the law does not apply.

Isn't the exploitation of children the reason for child pornography being illegal? So if no child is being hurt, then why is fake child porn illegal?

Theoretically, if all real child porn was replaced with fake child porn, couldn't that lessen the exploitation of children?

When posting a rant in response to a linked article, it is generally wise to read said article:

The 2003 Prosecutorial Remedies and Other Tools to End the Exploitation of Children Today act (PROTECT - Public Law 108-21), defines computer images that are indistinguishable from real children engaging in sexually explicit conduct as child pornography, while simple drawings which are easily distinguishable from real children are not considered child pornography.

Being nekkid != porn. Kind of like how your mom can't get nailed for kiddie porn when she shows your SO pics of your nekkid backside in the tub. ;)

Considering they dont sell Kiddie Porn Anime here in Australia, just the R Rated stuff - which now qualifies under the new ruling. IF Lolita were an Anime, it would Qualify as Kiddie Porn for even suggesting the relationship between child and adult.

Note to Self: Must ban Lolita.

But that isn't the representation of the sexual abuse of a child therefore the law does not apply.

"...simple drawings which are easily distinguishable from real children are not considered child pornography..." -2003 CHILD PROTECTION ACT

"...Whorley's conviction for receiving cartoons is the first conviction under the statute..." extending the concept to include Anime broadly and not just 'bad' stuff.

While it sets a precedent for the extention of the law to include any sexualization of drawn characters in a comic that appear to be 'under age' but It is going to cover the destruction of children (not just sexually) but in violence. Those R rated Comics and Films where Kids get caught in a cross fire of bullets will now be subject to this.

Know what? If you say that the sky is falling, I'll just go ahead and respond "ok". We can what-if 'till we're dead. Personally, I'd rather spend my time doing something other than searching for a helmet "just in case".

Wait, what? No. That's ********. Does "Innocent Until Proven Guilty" not ring a bell? If they haven't actually commited a crime it is immoral to prosecute them on the basis that they might.

That's not how the law works. Something has to be a crime on it's own merit, not on it's power as a predictor. Otherwise we get into the territory of thought crimes.

And before you ask, I don't have children, but I'd stand by this statement if I did. The price of freedom is safety, and every time you try to make the world a little bit safer that's what you chip away at.

May I rise a practical question at this point? Why is kiddie hentai so bad? I always thought the whole point of hentai was exactly to help people with morally questionable fetishes without bringing them in conflict with their ethics. I mean, the reason for child pornography being banned is the damage inflicted on abused kids. The moment said kids aren't real, I don't think there's a reason for banning it.

None, as none of my anime is child porn.

Sadly it might still be illegal under the obscenity laws (if you live in the USA anyway.) and no you don't know its not, nor would a lawyer.

Anyway Neil Gaiman sums this up better then I ever could.
http://journal.neilgaiman.com/2008/12/why-defend-freedom-of-icky-speech.html

For those that can't control there ADD to read that here is a summery.
If you accept -- and I do -- that freedom of speech is important, then you are going to have to defend the indefensible. That means you are going to be defending the right of people to read, or to write, or to say, what you don't say or like or want said.

The Law is a huge blunt weapon that does not and will not make distinctions between what you find acceptable and what you don't. This is how the Law is made.

I don't care enough for amine to have that loli-hentai crap or if they make a law against that loli-hentai crap. Also one might debate based in what you just said that If some one got some real life **** material from a third party is not moraly wrong.

P.S. I know a thing or two about "The price of freedom" ;)

Eh, I'm just saying that using "child porn leads to child ****" is a ****-poor argument for making child pron illegal. If it's not immoral/illegal on it's own merits, it shouldn't be illegal/immoral because it's a vague predictor of another illegal activity.

Don't get me wrong, I have a whole host of other complaints, but I'm not really interested in getting into a freedom of speech discussion right now.
