#6 zombie_babies Aug 04, 2011 15:45:51	It's like how when an ATM bricks and gives you more cash than you have in your account taking it is theft.  It's not your money and it wasn't 'given' to you exactly.  He was getting refunds - in other words, getting the money he spent (his money) back - but at double what he spent.  Half of that money was his.  The other was not.  So, theft.  Mistake or not, the fact is the money wasn't his and he took it.

Nobody was persecuted for stealing since the ATM was giving out the money. It was the bank's fault, and they were the ones that had to deal with it.

Yeah, not how it works here.  If you wake up one morning and find out you've got an extra $1 million in your bank account, it's on you to report the error and give the money back.  Just how it works.  Now if you make a mistake as it relates to the bank, it's on you.  So yeah, maybe not fair but how it works. He turned himself back in. Based on what charges he had I would've just let him off the hook for finding a glitch in the system and fessing up. He turned himself in after the glitch was discovered.  Odds are he wouldn't have if it hadn't been.

#13 The_Silversword Aug 05, 2011 1:58:43	I would call the guy a genius! But he turned himself in? D'oh!! And yeah I dont see how they could charge him with a crime, sure he exploited their system, but it was a pretty dumb system, anyway its not like he stole it, the phone just gave it to him.

Not fair at all, really. I can see where people who say the USA is ruled by the companies are coming from   They should at the very least make all errors and mistakes work the same way. Not screw over the customers and favor the companies.

Not screw over the customers and favor the companies.  Yeah, I agree.  But dem's da rules we get to play with.  Yay us!  Re: He turned himself in, OMG!!11eleventy!! Ok guys, look.  He had to.  See, he took the money (theft) to make bail.  That means he had to come back to court to answer to the charges he was arrested for the first time.  So it was a warrant if he didn't turn himself in no matter what.  For two incidents instead of one.  Really, it was the best thing he could do.
