Apparently so are pens.  Well, at least pens wielded by a crazed smoker.

I'm assuming it's not allowed to smoke on the subway? (I know it isn't here)

If that's the case, the guy is an #$@% and should be shot in the face.

Yeah, no smoking on the subway is permitted.  I guess there's more to the story, too.  I heard on the radio this mornin' that she wasn't quite as nice about it as the article makes it out.  Still, she didn't do anything that warranted that kind of response.  Think about this, though: if smoking on the subway were legal, she'd likely have been less inclined to say something and would, therefore, have been less likely to be stabbed by a pen.  In the face.  So, you see, allowing people to smoke wherever it is they wish would be a net societal gain and vastly improve the safety of non-smokers!

It's usually not the case that people randomly stab others in the face for saying something. There's generally some other non-niceties to spark that kind of reaction.

Still sucks to have it happen to you, of course.

Yeah, words - no matter how annoying - never warrant a physical response.  Even if she was the cattiest cat in the cat box she shouldn't have been stabbed in the face.

Typical.  Throw as many charges at the suspect as possible in order to allow for some sort of fine and punishment wiggle room when the prosecutor inevitibly offers a plea deal.  And, failing a plea, it's another charge that may stick if others do not when it goes to trial.  It's a racket.  They charge you with as much as they possibly can in order to make sure you get punished somehow.
