Are you able to use sneak attack outside of combat?. Say your teammates gets close to a monster can you use it? Im trying to think of ways to throw our DM off or at least make him think. So like i said is this stretching the rules or would it be up to your DM.
Sure you can use your Sneak Attack out of combat, thought it may very well start one

In general though, attacking an enemy caught unaware like this would probably be treated as a surprise during the first round of combat.
As Plague said, sneak attacking someone would start a combat.
I'd require you to make a sleight of hand check against passive perception of the target before allowing you to do this.
Sneak attack might also end combat.
