Maximize Wracking Touch = Max damage Sneak Attack?

If a rogue/wizard type with the Maximize Spell feat or a maximize metamagic rod maximizes the spell Wracking Touch (C-Adv), will the sneak attack damage be maximized as well?

Maximize Spell [Metamagic]
All variable, numeric effects of a spell modified by this feat are maximized. Saving throws and opposed rolls are not affected, nor are spells without random variables. A maximized spell uses up a spell slot three levels higher than the spell’s actual level.

An empowered, maximized spell gains the separate benefits of each feat: the maximum result plus one-half the normally rolled result.

Now, the only variable numeric effect of "Wreaking Touch" is the 1d6 damage it does, sneak attack damage is not part of the spell itself.

I'll admit it is a bit unclear where the text says "take sneak attack damage from this spell", tho.

The spell isn't that bad, if you don't use metamagics with it (except for Reach Spell). It becomes horrid when you combine it with metamagics, with or without metamagic reducing features.

True. But what caster doesn't use metamagic? Odds are if you're using a spell with no save/no SR, and can drop a dragon in 1 hit, you're probably using it to drop a dragon in one hit, which means metamagic... Most DMs will either ban it or use it against the PCs, the latter leading to more TPKs then necessary, imo.

What I was saying: use the spell as is, maybe w/ reach spell. Don't abuse the abusable spells, which also includes Polymorph.

Unless it has been changed, Shivering touch has SR. At least in my Frostburn it does.

@ jwo: I agree with you. Using it in that way is not abusive and not normally game breaking. The problem is the temptation. A lot of people won't be able to resist the temptation and that brings out bans and hammerguns and all sorts of unpleasant things... But no, the spell is not broken in and of itself, just the most common uses for it. Same with Polymorph ;)

I house rule that spell as a penalty and not damage to Dex.

Really? I buy three full wands of it (all at CL 20+), load them into a Rod of Many Wands, and then Metamagic Spell Trigger the hell out of that.

Why is that? Well, the spell creates some shuriken that do fire damage (3d6). However, it also changes all sneak attack damage done with those fire shuriken into fire damage. Hence, the spell effect includes fire damage from sneak attack.
And that could be maximised. Well, in theory. I don't see that it could ever fly in any real game.

There is of course also the spell "Eyes of the Hunter" from PHBII, where you could argue that by gaining Sneak Attack dice the spell effect is what is doing the damage - and hence that it could be maximised.

Makes sense. The Spells don't say "Effect: Sneak attack damage", hence they can't be maximised.

I know you could have it continuously enchanted on yourself, but is it possible to have it on your weapon?

From this day forth, you will only ever meet undead. Or the Tarrasque.....

But going by standard enchanting GUIDELINES it is easily possible to do that.

Use-activated Shivering touch enchantment:

CL 5*3*2000gp

Er... just noticed it probably won't CHANNEL. But you could make it cast itself into a spell-storing weapon.

Penalties from the same source don't stack, so that won't be any more effective than a single Maximized casting.

The Shivering Touch spells specifically deal Dexterity Damage, NOT a Dexterity penalty. So no stacking problems with that line of spells, barring house rules.

Yes, but Sinfire's response to was to someone saying that they did, indeed, houserule it to a penalty so the 'gatling wand' wouldn't work.

The stacking rules explicitly only apply to penalties and bonuses. Ability damage is neither: it's damage. It doesn't need to explicitly point this out, just like it doesn't need to say "things fall down if not supported". It's assumed, and game balance is not guaranteed if you ignore it.

Or would you argue that multiple Fireballs don't stack?

All damage stacks, or you would find Longswords would never be able to do more than 8 damage to a monster no matter how many Knights wielding longswords were hacking away at it.
