Here is my first build. Its a character thats supposed to betray the party later via a gm okd event so im trying to make him useful to the group but able to kill a party member worse comes to worse.

Race: Whisper gnome
Feats: Two weap fighting, Weapon finesse, Far shot, Point blank shot, weapon focus ( dagger)
rogue 5/ fighter 2/ invis blade 1

I plan on taking invis blade the full way and then jumping into assassin. any good ideas or pointers would be appreciated.

This is a very simple yet usually effective dagger build
1. Rogue - Craven
2. Rogue
3. Rogue - Two Weapon Fighting
4. Swashbuckler -B: Weapon Finesse
5. Swashbuckler
6. Swashbuckler - Point Blank Shot
7. Fighter - B: Weapon Focus: Dagger
8. Fighter - B: Far Shot
9. Fighter - Improved Two Weapon Fighting
10. Fighter - B: Weapon Specialization Dagger
11. Invisible Blade
12. Invisible Blade - Precise Shot
13. Invisible Blade
14. Invisible Blade
15. Invisible Blade - Greater Two Weapon Fighting
16. Master Thrower - B: Quick Draw
17. Master Thrower
18. Master Thrower - Rapid Shot
19. Master Thrower - B: Snatch Arrows
20. Master Thrower

For an assassin Rogue 2/ Swash 3/ Assassin 9/ Telfammar Shadowlord 6
1. Craven, 3. Dodge, 6. Mobility, 9. Spring Attack, 12. Blindfight, 15. Martial Study Shadow Jaunt, 18. Martial Stance Assassins Stance or Darkstalker.

My questions to you is what books do you have access to, what are the ability scores for this character, and does your DM allow flaws?

Rogue 3/Swashie X with Daring outlaw works much better for most builds than Fighter will. Daring Outlaw allows the two classes to stack for purposes of determining Dodge bonuses and sneak attack.

Make sure you take the penetrating strike ACF instead of trapsense. It's in Dungeonscape on page ~13, gives you half sneak attack when flanking creatures otherwise immune to sneak attack.

I personally would probably go:

Rogue 3/Swashie 12/Invisible Blade 5 (not necessarily in that order).

That gives you 11d6 sneak attack with daggers (before items/spells), BAB of 19, evasion, grace +2, +2 Dodge bonus AC, improved flanking, and Int to damage and AC. If I needed an extra Feat, badly, I might sacrifice that last 'dead' level of swashie to lose 1d6 of SA for the feat.

Take enough ranks in UMD to reliably activate a wand and buy wands of Persistent Blade (SC) for when your BSF isn't tanking, and you'll always get at least half that SA damage, even against immune targets.

It's, unfortunately, all melee at that point, though, so you need to make sure you have items to cover mobility.

get yourself some deathstrike bracers from magic item compendium, add on the effect of bracers of murder from drow of the underdark when you can

The usual CO response to assassin builds is:

You can be an assassin-flavoured character without actually taking levels in the assassin prestige class.

And to be actually of some help to the whole build:

I say go unarmed, changeling rogue x/monk 2/rogue y and pick up the ascetic rogue feat.

Important alternative class features: invisible fist, feign death or spell reflection, changeling rogue substitution levels, penetrating strike, disruptive attack.

You end up with 2d10 unarmed damage (unarmed damage is easily boosted and on the plus side you have sneak attack to add to the mix). Thanks to penetrating strike you will be able to flank-sneak any creature normally immune. Invisible fist gives you an easy and cheap way of getting sneak attacks.
After a few levels, grab a scorpion kama, which has a base damage equal to your unarmed damage, if that's better. It is a slashing weapon, which makes it eligible for the whirling blade spell. With some eternal wands and a couple of ranks in UMD, you can turn invisible and immediately hurl your kama to your enemies, dealing sneak attack, unarmed damage and possibly debuffing them with an ambush feat.
Also grab carmendine monk so that your monk abilities (stunning fist and AC) are keyed off int instead of wis, which will lower your MAD.

Another well favored option is the swordsage\teflammar shadowlord layout, which produces a great deal of punishment if laid out properly. It's a little outside my area of specialty, since I like to either cast or smash. My apologies if this is less help than desired, but...

Well some of these classes are new to me. does the swashbuckler have a steady SA progression or does it just have stuff that makes up for it

On a side note, Im more than happy to have an assassiny type char without having to take the PRC. the thing I want is when I strike I kill as quickly as possible and as sneakily as possible

check out the tome of battle build compendium in the "useful links for CO work" thread sticky'd at the top of the forum, there are a bunch of stealth combat focused builds in there. I'm personally a big fan of Beshadowed Blade v2.

That sings a song of blood and fury, whose lyrics lie in the tome of battle. Please, follow Reis's excellent advice.

Swashbuckler is in Complete Warrior. It gives you Weapon Finesse for free and Int mod to damage at 3rd level. It only gives you sneak attack if you have sneak attack already and then take the feat Daring Outlaw from Complete Scoundrel

Why not drop a level of Rogue for Dread Commando?

Penetrating Strike alternative class feature from Dungeonscape is much more useful. You esentially trade the 3rd level rogue's trapsense for the ability to do half damage on sneak attacks to things normally immune to sneak attack.

I wholeheartedly concur. If you are planning on playing anything that relies on sneak attack damage as your primary source, you'd almost be a fool not to take this ACF if at all possible. About the only exception I can think of is for Sneak Attacking spellcasters who would lose 9ths if they took three whole non-caster levels.
