Here's one take on it. I haven't read it though.
Do you happen to have access to monster manual 3? There is a creature in it called a Phoelarch which is believed to be descended from the phoenix. It’s a monstrous humanoid with 7 racial hit dice and a level adjustment of 5, so it’s very easily within playable parameters without being broken. If it’s just the flair your player wants (pardon the pun), I’d suggest using that instead.
The fiery discorporation psionic power is also kind of phoenix-like in its function. Once you've got past the phoelarch and a monster class for the actual MM2 phoenix, you're starting to look at ways to be like a phoenix rather than actually being one in any racial sense. You could also look to see if anyone's done a monster class for the phoelarch.
I guess you could have a raptoran cleric who burns himself to death after casting a pact of return against death by fire.

Emerald immolation is extremely close, though at 1/week, it's not exactly something you'd use a lot. It does, however, destroy you in a fiery blast and reforms you within a few rounds.
In comparison, fiery discorporation is easy to use, but takes an entire day to reform you and doesn't create a damaging blast of fire. Pact of return also doesn't create a burning blast, and requires that you know the approximate manner of your death, but it restores you immediately, and it can be used very frequently, like fiery discorporation.
You could, of course, skip the phoelarch and go with something like a raptoran jade phoenix mage, which would be the non-monstrous option. Using swordsage as the base class on the maneuvers side would give you access to firey techniques from the Desert Wind discipline, though the swordsage's use of Wisdom means that you're covering an additional ability score that's not used by the spellcasting side (while the crusader and warblade lack normal access to Desert Wind).

And the PC wants to actually BE a Phoenix. I just am not sure how to go about it. I presume it is an epic transformation spell and the game actually needs to be epic (looking at the Phoenix's CR and HD)
Problem solved.
You could consider the basic mythological shtick
of the Phoenix to be a Contingency and a Raise Dead.
That's rather powerful at level 1, but not a necessary
combo when those spell levels are normally acquired.

Let's say you have an NPC named "mom" who puts
a payment plan in place with the local spell services.
She (well this is d&d so we don't really know the gender)
(heck, what would the gender of the mom of the Phoenix be, in mythology ?)
... pays for both of those spells, and it isn't all that expensive.
Perhaps a 1 racial hit die Magical Beast level,
plus an LA +1 for the backstory spell thingies.
No LA buy-off, then advances as a PC after that.
That won't break the game.
Just don't call the fluff Order Of The Phoenix.
That'll attract the attention of some Slaads.
