Delve and Open Background questions

I've read wolfstars LFG guide to what is legal or not and hunted around a bit on the forums here and I have a question or two about Backgrounds and Dragonmarks.

Now the D&D open the character creation rules say Eberron and Forgotton realms backgrounds and dragon/spellscar Marks are not allowed it also says everything in the PH2 is legal so are PH2 backgrounds legal in the Open.

In the Ultimate Dungeon Delve rules there is this:
"Anything that is a legal option for the D&D Character Builder is legal
for play; this supersedes the “Player Resources” section on
page 2 of this document."

By this I assume that Dragonmarks and spellscars as well as Eberron/FR backgrounds are legal in the delve.

I'm pretty sure I know the answers to these questions but I want to be absolutely sure, I don't want myself or my team to show up with illegal characters (one is coming from Germany and it might be difficult for him to change his character on the fly).

Thanks for any enlightenment.

You are correct about the Ultimate Dungeon Delve.

What's in the Character Builder is fair game. That means if you want to be a Hyrbrid class, you may be.

If you want to play. . . a Bladeling, but don't have the RPGA Rewards card? No problem, since its in the CB.

If/when you return to Living Forgotten Realms, however, the restrictions from "my" Legal Options list come back into play.
