Bundles and DM Fiat

So, what's the law of the land when it comes to treasure bundles?

I was of the general impression that it didn't much matter whether you found the loot in the module at each specific location during play or if you disenchanted it or used an item beyond your level during play. At the end of the module, you got to pick your item from all of the available bundles and that was that.

Is there some level of DM fiat allowed? If you successfully negotiate an encounter but happen to forget to mention searching the area or the the bodies, do you not get access to that treasure bundle? What if you fail the encounter?

Strictly speaking ... if you fail the encounter, skill challenge or fail to do the action required to get the item (searching is a dicey one), then no, you shouldn't get the bundle. My opinion.

As a GM, I tend to give nudges to people if they aren't doing what is necessary (like asking certain PCs questions, or going to certain places), but if they decide not to go there, they don't go there. It is, arguably (and it is an argument that's been had multiple times elsewhere), a problem with a module's design, if having done everything successfully to complete the module, the players/characters still fail to gain access to some item or other.

But, GMs are there to run the module, not to write their own. That's one view.

The other view, is that GMs are there to make the game fun, where fun has many connotations but certainly failing to give the players some of the XP, GP, treasure, etc constitutes "not-fun" to many folks.

If you skip an encounter which has a treasure bundle in it, then you should not get it.  Saying if you fail to defeat the encounter,...probably not, but that may depend upon the situation.

Technically, you do need to find the item, and in some LFR adventures, a minor amount of searching is required to do so.  As a DM, I will ask "do you search around?"  Since LFR is intentionally not like LG (and I detest the phrase of "Greyhawking the bodies"), explicit statements of extensive searching should not be the objective.  If the PCs succeed at the encounter, the DM should nudge the players.

There may be treasure bundles at the conclusion of the adventure, or dependent upon completion of a Major Quest, which do have criteria for obtaining.

If the players sold, destroyed or disenchanted a magic item during the adventure, then it is not available to them at the end of the adventure.  Just like if you spent gp, then that is an adjustment to what gp you gain at the end of the adventure.

Exception:  you may consume things like potions (of healing) and the consumables that might be offered in the treasure selection will still be available (because basically you are buying them).

Be sure to read the adventure boilerplate as a DM as it generally explains this stuff.

I believe the rule about not being able to use magic items more than your level+4 is a core rule found in the PH. Therefore, a lvl1 character can never use a lvl6 item regardless of whether he chose it in a treasure bundle, just found it in the mod, or it was loaned to him by another player.

I believe the rule about not being able to use magic items more than your level+4 is a core rule found in the PH.

It's a campaign rule.

CCG, p. 9, second paragraph, big bold letters: "You cannot use or sell a magic item more than 4 levels above your character’s current level."

It doesn't matter where the item came from, who owns it or when you discovered it, you cannot use or sell a magic item more than 4 levels above your character's current level.
