What is not a part of the Open Game License?  I know the Open Game License allows for the publishing of similar games to D&D (Pathfinder), but what is not a part of it?  What is barred?  Here is a list of things I will put down, let me know the specifics on these if you can and add anything else you feel, also, thanks in advance.

Monsters
1) Beholder
2) Umber Hulk
3) Tarrasque
4) Rust Monster
5) Mind Flayer/Ithilid
6) Gibberlings
7) Purple Worm

Races
1) Goliath
2) Drow
3) Deurgar
4) Svirfneblin

Classes
1) Artificer
2) Factotem

Spells
1) Magic Missile
2) Globe of Darkness
3) Faerie Fire
4) Magic Armor
5) Prysmatic Spray
6) Any other spells

Skills
Any of the skill names

Feats
Any of the feat names

Racial Traits
Any traits given to races

Maybe the SRD I use contains things that aren't actually part of the OGL but I see monsters 3,4,7, and maybe 6 (gibberling mouther?), the races except goliath, the specific spells you have listed except 2, and most of the skill and feat names (along with descriptions) and racial traits.

There means from your list I don't believe those two classes are OGL (and most that aren't in the PHB/DMG are not OGL) and neither are the Mind Flayer and Umber Hulk monsters or Goliath species.

When it comes to what is not in the OGL what stands out the most is that none of the XP and levelling related information is part of it and neither is ability score generation.  The amount of XP you need to go from one level to the next, how much treasure you earn, what your encounters are supposed to look like, and a number of other things in that area are NOT OGL.

Thanks!  So Goliaths are not OGL, kind of a bummer.

D&D 3.5 generated XP and Feats gains like previous Fallout games.  In Fallout I remember gaining levels based on the same EXP table as D&D 3.5 and perks at every 3rd level.

Look at the SRD. Anything in the SRD is OGL. There is also tons of OGL material out there from third party publishers. And you can always make your own stuff, even if it is thematically similar to an existing race/monster/etc.
