It seems that Divine Smite dice are subject to the Crit rule of "If the attack involves other damage dice, such as from the rogue's Sneak Attack, you roll those dice as well.", purely based on the similarity of wording "..you can (deal/spend)...", and the fact that Sneak dice *are* subject to the rule, as outlined in the "Critical Hits" section.
But the timing seems wonky, in that it seems you can declare to use them (or not) after you see what your attack roll is (and maximize their use on a Crit). Just making sure I am reading the RAW, and understanding the evolution out of the playtest rules.
It's a balance, it seems at least for Divine Smite, as you aren't going to expend spell slots on a miss.

You swing, (d20) stick the weapon deep into the enemy (crit) and channel positive energy down the blade into the evil beasts heart (smite). |
