So me and my DM are debating the RAW of the spell Hex (1st level Warlock spell). Mainly we are at odds as to whether Hex can be "resisted" or "missed" under any circumstances aside from full magic immunity, ie Rakshasa.

There is no attack roll, so the spell cannot miss. There is no saving throw, so you cannot save to prevent the spell from working.

Immunity to 1st level spells would prevent it from taking effect, and as the spell states it can be ended with a remove curse spell.

Beyond that, your only recourse to limit the spell's effects upon you are to try and break the caster's concentration.

Resistance to necrotic damage would help with the damage part, but not the disadvantage portion.

Disadvantage to ability checks is only really good for making it easier for any grapplers on your team to grapple targets with high strength or dex.

Outside of combat, for your socialite to win a persuasion/deception/intimidate check against someone. Or sleight of hand. Or a lot of stuff, actually.

Hex is one of those powers that's always worth taking with Magic Initiate. If you can't use Charm Person, then Hex and pray for high roll for you and low for your enemy. And since Hex gives you access to the Warlock spell list if you use Magic Initiate, Hex is always worth taking on a high Charisma character, since you get the all-consuming Eldritch Blast as a cantrip choice.

My Assassin/Shadow Monk/Archfey Bladelock likes to use hex to give an opponent disadvantage on Wisdom checks. This helps him be way, way sneakier around them.

Honestly, it's hard to not get something like Hex for Way of Shadow. You can use it to get advantage on sneak against guards, give you extra 1d6 damage in combat EVERY TIME YOU HIT SOMEONE, and use it for pretty much any social interaction you feel like using. You can even roleplay it for Way of Shadow by saying that being one with the shadows makes people unnerved about dealing with you, and being more likely to agree with whatever just so you go away.

If I was going to houserule something for FAIRNESS, I'd probably houserule that only someone with Warlock levels can take Hex and Eldritch Blast. They're just too good.
