Need Advice: Killing an Epic Rogue - lvl15 party - 3ed.

Our party has angered an epic rogue over some paintings that we denied him.   Last session he stole all of the party's best items and I would like some advice on how to defeat, capture or kill this retch.  We cannot hire The Garrote as he is a low ranking member of that organization.  We have access to Union.   

Party Makeup:
lvl15 Cleric (who has every rogue ability except sneak attack, no ACP and 56AC, 69AC in a suprise round)
lvl16 Sor (who cannot cast damage spells, he is an expert at crowd control, vow of peace, non-violence)
lvl15 Ranger (melee DPS guy, two weapon fighter)
lvl 15 Paladin (great tank, dragon-like mount)
lvl 15 Warlock (most boring class ever, lots of damage).

Our Reasources:
-Over 750,000 gp. (if we pool all our money together)
-Our party is extremely well equipped minus the stuff he stole because a DMing mistake
-About a dozen spell books from wizards we have killed throughout the campaign; we also possess numerous potion and scrolls

Any ideas or help will be greately appreciated!

1) does the warlock have scribe scroll & UMD maxed out? at that level a warlock can make magic items & use UMD instead of actually casting the spell. if so you can take your time to pretty much just scribe all the scry & die you require.

2) this rogue is dumb. if he was able to sneak in & steal your stuff, but still keep you alive, int (or at least wis) is a dump stat. either that or he wants you alive. use this to your advantage.

3) do you know what resources he has at his disposal? it's a non-caster so he's got that as a big mark against him, but he can still have people cast spells & buffs on him, or UMD a scroll or two.

we have an idea of your resources, but without knowing him all i can say is "find him and drop a druid nuke on him"

Our warlock has UMD maxed out but does not have scribe scroll.  We can just buy whatever scrolls we want... but which scrolls are most effective versus a rogue like this?

He has ridiculous DEX, so much so that ranged touch for the purposes of spell casting is in-effective.  He also has SR greater then 35.  Our combat people can only hit him on a 20. 

What do you mean by drop a druid nuke on him?

yeah, that "rogue" sounds more like a "deus ex machina" then anything else. ridiculously high SR, AC, touch AC, ect... sounds like a GM who instead manning up and saying "my bad for giving the items" tried to remove them in-game with a "epic rogue".

step 1) buy these items:

Scroll of Teleport/greater teleport
Scroll of either Scrying or Greater Scrying
Scroll of Cloudkill
Scroll of Forcecage
Scroll of Wall of Force
scroll of flesh to stone
Scroll of transmute rock to mud
2 normal, non-magical sledgehammers & glaives

2) have the cleric prepare deathwatch, speaks with dead, create water, purify food & drink and as many Dispel/Greater Dispel as he can.

3)so we don't know his resources other then "gm fiat". the easiest way to get to him is to scry on him with the sorc/warlock until you can find him alone in a room, have the cleric cast deathwatch and have the ready a greater dispel to counter any scroll/item our rogue might cast from this is the cleric's only job, to disrupt the rogue's attempts to get away and tell you when he's dead. teleport over with the scryer. before teleportation have the non-scryer of the two ready to forcecage him in place immediately.

now, have sorc/warlock to use a cloudkill from a scroll (causing 1d4 con damage a round, fort save half, lasts 1 min/level) the other ready to cast wall of force from a scroll after cloudkill is cast, locking our cloudkill in place and the rogue somewhere he can't easily get out of. even if he stops moving don't dispel anything until the cloudkill dissapates naturally. drop the wall of force.

have the ranger & pally repeatedly coup de grace our friend using the glaives from outside the forcecage until he's "dead" (which the cleric can tell you when thanks to deathwatch). drop the forcecage & have the cleric speaks with dead to find the location of your stuff. now cast in this order: flesh to stone, transmute rock to mud, create water, purify water. this will turn the body to stone which you will smash to gravel, said stone to mud, diluted in water & the muddy water is purified from dirt and now drinkable. take said water and throw it in different places.

here: a plan bypassing SR, touch AC, normal AC and no saves to worry about overcoming and able to be pulled off pretty quickly.

Wow, Oxybe, I really like your style. Especially how you minimize the guys advantages and then go so far as to pulverize him into effective nothingness. I would like to face you someday, you sound like good competition. I also agree with your situation assessment, he, epic rogue, sounds like a poor DM fix in which he's robbing the players because of his 'mistake.' I think there are better ways to handle such and this way gives the players a path to get their gear back.

Here's how I would do it.
First of all assess him
He's going to have insane saves. Even if you beat his unstoppable SR even his 'weak' saves are going to be good.
Counter- See Oxybe. You use spells that don't give SR or saving throws.

He's a much higher level than you so you won't have Can't be flanked working for you.
Counter- It seems like he doesn't have any friends and if he does they would be lower levels than your group. He loses a lot as a rogue fighting by himself.

He'll have epic feats, and magic items.
Counter- The best strategy is use your enemies items against him. Steal from his own stash! I'll tell you an easy way to find your stuff, him and his stuff!

He'll have better contacts than you and more prestige most likely.
Counter- He's likely pissed off a lot of powerful people. You can contact them and make arrangements, even get paid for killing him. Also, if he's in an organization, you can run his name in the mud and then offer a stellar reward for his capture or death. Rogues aren't known for their loyalty.

If you guys do it right I count you as having infinite resources and access to everything in the DMG. If you can't buy it I assume you can steal it. Your major advantage is that you have more actions per round than he does. No matter how awesome he is he'll be overwhelmed quickly with the right combo of spells. I'm not sure what a warlock can do, so I'll consider him a wizard.

Here's what you do. First of all maximize the best of each member of you party by getting the appropriate gear (Gloves of Dex, Belt of Gi Str). I would normally go for balance, but he's so strong you are going to each have to specialize and over power him one area at a time. Get spell buffs like Mass Cats Grace on scrolls to gain a further advantage. I would also maximize all armors and weapons, you are going to need the best of the best stuff. Also research every spell you can that has either no save, no sr check or goes off of fort and will which are his weakest saves. Get the best ones in scrolls.

Second, you need to find him. Now I assume as Mr. Epic Rogue is epically epic so your stuff doesn't appeal to him; he's got better. I think he just stole it to piss you off (the dm doesn't want you to have it) so even if he wears one thing he will stow the rest. Locate Object will lead you to your stuff! He'll likely keep it with the rest of his stuff so if you find his horde you'll get all kinds of goodies. He should be much, much harder to find. If he's smart he's obscuring his location with an amulet or some such. Sun Tzu says choose the battle field. If you can't scry for him then create a situation where he comes to you. I would create an elaborate dungeon, so easy with powerful wizards to cast stone shape. Then I would have an awesome item available for the taking. He'll come for it, especially if others spread tales of horror and failure! That's when you jump him!

Third comes the actual encounter. Hopefully, if you used the treasure ruse, he'll be some what spent, but I wouldn't count on that. First nail him with your most powerful anitmagic stuff. I would say Morts Disjunction, but you aren't high enough. I would hit him with Dispel at least and have an antimagic field for back up. Now if he's smart he'll try to flee!! Hit him with Dimensional Anchor or even lock so he can't escape quickly. Now here's where you can vary. He's super strong so you could turn his stuff to wood, or rust touch him if available to strip him. After that your fighters should be able to pound him bc he is just a rogue after all. Alternatively if you don't think you can win in combat I'd say Transmute Rock to Mud and have him fall waist deep in the mud and then quickly turn it back! He'll literally be stuck and if the dimensional anchor holds he can't teleport away. You can do anything then, like drop a wall of steel on him and dance on top of it til dead. Make it fun ethnic dances like the Mexican Hat dance for a demoralizing affect.

Now Oxybe went crazy with smashing him to itty bitty pieces but that's over kill and technically useless. He could have a clone spell, activate on death animate new identical body, or true res at the very least as either a contingency spell or cast by an ally. In 2nd there was a neat spell called Soul Trap, the opposite of the Sould Gem spell, but neither seem to exist in 3rd . In a 2nd game I used this very scenario and lost the fight and the guy went to steal the 'treasure' (a guady begemed trophy) and he fell over dead. Soul Trap uses a gem to trap their soul which would prevent most forms of res. If he freely accepts the item (takes it as his own) and if his name is on it then there is no SR or Save accordingly. Plus, once in the gem he becomes your slave, being forced to answer anything you ask which can lead you to your stuff if you couldn't find it, or more goodies and even plot lines if you DM is worth his salt. Alternatively you used to be able to offer freedom for a service of a year and a day which would have it's own uses. I'll look for it because I have lots of magic books.

Just remember this, speed is everything! Have the Scor and Wiz using Quickened spells to do the dispelling because you have to get rid of his goodies because they'll be epic fo sho. Everything else depends on Dimensional Anchor and either combat or magic. Just hit fast, hard and often or you won't get a second chance.

if you've got 750K gp to spare, go for style man. style. punch it home that you should not be ****ed around with, though this rogue does seem to be a DM fiat in a sneak attacking box though, so any plan the PCs make may as well be useless.

it should be noted that a good soldier doesn't leave any body behind (because if he's raised he can come back and CdG the **** outta you guys if he's learned his lesson, and this guy has proved he's got the stealth to get to you).

i was also just going by core only. if you want me to i can scour my library of D&D books for another solution but this might take a while. the main issue is destroying/trapping the soul in some fashion.

off the top of my head, i guess if Spell compendium is allowed you do have access to barghest's feast (level 6 cleric, level 7 sorc/wiz), which destroys the body (which stops any resurrection that requires a corpse) & has a 50% chance to permanantly stop wish/miracle/true ressurection from ever raising him. note: it's an [evil] spell so unless the cleric isn't so inclined, get one more scroll.

if you're talking about Trap the Soul spell, it does exist in 3.5 but it requires this guy to grab an item that he willingly left behind the first time around when he met the PCs in their sleep.

either way, i dunno. the whole initial scenario sounds like the GM trying to go about taking back stuff he regretted giving, but in a very roundabout and jerky way

I agree with your assessment, I just didn't want to say it... I don't like being rude to DMs.

Although all your advice was spectacular, this is the part that I enjoyed the most   I really agree with your Sun Tzu quote.  Have someone else pay us to kill him: brilliant!

Oxybe and Unknown, your advice has been very enlightening. There is a small glitch in Oxybe's plan but I will convince my party to go through with it anyway; I know the chaotic neutral ranger and the lawful evil warlock will be down with it.  The problem is the sorcerer’s exalted feats: we receive penalties for killing a helpless person but in this case it is totally worth it for two reasons: (1) this rogue has angered myself and the party fiercely and (2) this plan is too brilliant to go to waste. I intend to do carry out Oxybe's plan with all the advice that Unknown gave.

My cleric is true neutral and throughout the campaign I have not had any qualms evil spell. The warlock can also get scrolls so this won't be a problem.


 A Taste of the Items he Stole:
+10 vorpral keen scimitar (paladin's)
+10 frost, shock, sonic, flaming, acid Ugrosh (ranger's)
+5 proficient prismatic striking shadowform Dire Pick (mine, I don't really do melee combat though)
+5 harmonizing dagger (bard's... doesn't travel with us anymore)
Restful Crystal
Ring of Sustenance
(note that we have a house rule where weapon abilities and +bonuses are separate so a +5 vorpral sword is treated as two plus fives separately and there fore non-epic.  cost generator: ability squared times three thousand).

I would say one thing about Oxybe's plan you can't coup de grace unless he's held and helpless. I didn't see anything in his plans that did that, which actually should bring your cleric on board! I think force cage is a better route to go than dimensional anchor bc it has no sr or save and it keeps from teleporting away. It's been awhile since I've actively played so I missed that spell.

I like that you appreciate my way of shaming the enemy.

either way, good luck. truthfully, the best recommendation i can do is recommend you call the GM out on it and bring the issue out in the open rather then meet his roundabout way with your own. it's not rude of you to call him out on dropping a arbitrarily high level NPC to simply steal your gear and nothing more.

plus, the guy isn't "the GM", he's a friend and there's nothing wrong with saying "Dude, WTF man?" to a buddy if he pulls a jerkass move on you.

if the guy drops on the ground unconcious there's no problem with trying to CdG him (since you're helpless if you're unconcious). if he moves outside of "stabby-stab-slash" reach, it tells you he's definately still alive. if he doesn't then he'll probably have several organs glaive'd.

the CdGing is a "just in case" procedure. leaving something up to chance (especially against a generally more powerful enemy) is generally a bad idea, but like i said in my method there is a deathwatch in place to let you know if he dies. if he's dropped but not dead, either he's faking it or he's unconcious, which the reach weapons will let you find out through trial and error. if he's faking it you can try to hurt him in other methods, either through an obscene amount of attacks at reach (just spam "attack-attack-attack" and hope for the eventual 20. forcecage lasts 2 hours per level. plenty of time to spam stabs, arrows, bolts & eldrich blasts at him until he drops dead) or through other spells.

another no SR, no save spell:
Acid fog: 2d6 acid damage to all in it. you know, that whole "fog" series of spells are really just awesome. note that like cloudkill it's a spell that goes extends from you so you'll probably need to drop it before the wall of force, though a dual cloudkill+acid fog is my level of overkill.

Just to be clear, I am the cleric of the group: Clr/4 Divine Oracle/6 Contemplative/5, True Neutral, Hera is my patron deity and I have an AC of 56 (69 in a surprise round).

The DM did not explain.  We wrote it off as epic rogue.  This was especially bizarre for my circumstance as I have a decent spot check and I know it's quite eccentric but I sleep in a bath tub every night as my armour allows me breath underwater and I have a restful crystal.

There is a lot of weird things about our party... a lot. I could go into further detail but I didn't want to bore anyone.

I personally don't like this option but it is practical and the right course of action. I'm sure one of my fellow PCs will bring it up with me as I have e-mailed this brilliant thread to all of them.

Finally I failed to mention although it's not very important, he has robbed from us thrice. The first time was just some stupid paintings that our bard had acquired. The second was cheap magic items such as crystals and the like. The third (and hopefully final time) was all our primary weapons.

wow... robbed thrice? couldn't you just use a custom "X of alarm 1/day" at caster level 4 and just ward your campsite every night and make a loud noise when someone enters, or better yet activate it and tie it at one end of a 5ft length of rope and the other end is at a rope trick? a "bell of alarm" at caster level 4 is 3200gp to buy, 1600 to make. dirt cheap by most standards.

if you can't rope trick for some reason, anticipate teleportation & it's greater version (spell compendium) can give you a few rounds warning when someone is trying to poof into your general vicinity, as well as delaying their arrival. detect scrying can let you know if you're beeing peeked on. both these spells last 24 hours when cast, though AT & GAT will need to be recast if memory serves.

lots of ways to ward yourself from pesky burglars. no matter how high your hide+move silently is, this no save, no SR, auto-detect if you don't speak the password " BREEP! BREEP! BREEP! WARNING LORD MAGUS GRUMBLEBRONX! WARNING! AN INTRUDER HAS ENTERED YOUR COMFORT ZONE!" is a good deterrent.

3 basic spells are all you need to get a good secure defense going: alarm cast at level 4, greater/normal anticipate teleportation & detect scrying. maybe a magnificient mansion / rope trick @lvl 8 for extra security. hold portal/arcane lock on your doors/windows can help if you plan on staying at one place.

The first time, he stole the bard's stupid paintings.  I don't care. 
The second time, he stole my Greater Aquatic Restful Crystal from my armour.  Tedious and we did confront him.
Third time, the ranger flipped out when his weapon got stolen.

just saying, after getting your stuff stolen once even if it is just cruddy paintings or an easily replaceable rock, it shows that you're somewhat vulnerable to this, plus at higher levels some of this stuff is nice to have around for reasons other then a safe nap.

many demons & enemies have teleportation at will (teleport, greater teleport & dimention door are all spells that allow instantaneous travel and available at mid-high levels) so the ability to stall one from poofing where he wants to, you can delay his arrival and set the group up to attack him when he apparates or have him apparate into a trap/series of spells.

the ability to detect when you're being scryed on can have some benefits, especially if you're able to see the guy who's spying on you. nothing like turning his scry into a scry & die on your part. plus in 1-2 levels you'll be able to access mindblank (such an awesome 24 hour spell. good-bye worrying about being scried on, mind-effecting spells/effects & information gathered on you via divination like legend lore and such).

@ogiwan: quite true. there is only 1 level of dakka that is acceptable: "NOT ENUFF DAKKA!!!"

Just straight up ask the DM out of game if the reason he had the items stolen was because he didn't intend for you to have such powerful items in the first place and was trying to rectify his mistake.  If that answer is yes then it doesn't matter what you do in game, if the DM doesn't want you to get the items then you're not getting the items, whether its through him making an OP npc or by just having the items be sold/destroyed after that.  Players can work within the rules, DM's don't have that limitation...all it takes is saying he has a custom item/ability/whatever that teleports him away from the party, or even simplier something that prevents scrying. 

From the information presented it sounds like this guy is a new DM, or at the very least and no offense is meant, but not the greatest of DM's.  Really, the best thing you can do is talk to him about it out of game and let it slide and hope that he learned this isn't the correct way to remedy such mistakes in the future.

You have a good point but I would need some of my fellow PCs behind me to bring this matter up.  Some of them have read this thread and have not brought up the matter.  You were right in saying that he is a new DM: this is his first campaign.  None-the-less your suggestion although a good one and the right course of action is difficult.  Then again, it's just a game & nothing of significant has been stolen from me :P .

Frankly I'm more upset about the ring.

you got a bunch of CRAZY powerful weapons stolen, it sucks... but you should not have had them in the first place. So... it was a deus ex machina to get the weapons away from you. 

My suggestion. Don't fight it and just move on.


If you must fight the rogue.... you need to gain more levels and practice the fight. 

cloudkill, acid fog, solid fog, evard's tentacles, multiple force cages(solid and stacked), teleportation anchor, and a few epic spell if you can locate a spellcaster.  All of which need to be cast as quickly as possible(in the same round if possible) Area and action denile are the game(assuming he doesn't have acid resistance(which he's stupid if he doesn't have, and immunity to cloudkill(which is popular for being a retarded easy kill for just about anything so again retarded if he can't deal with it... heck a scroll of epic dispel is within his grasp... so why bother...)

I know MY epic rogue was able to escape force cages with mundane skill(epic skill use for the win) so at most he would be slowed down by the cages. And honestly there are several tricks for getting around the spell setup, all of which are fairly low level and easy to aquire for any epic character(specially rogues) ...

But again... my suggestion is that you don't try to fight, and just keep adventuring.   OR you may end up with ALL your belongings missing and you dead.

cloudkill, acid fog, solid fog, evard's tentacles, multiple force cages(solid and stacked), teleportation anchor, and a few epic spell if you can locate a spellcaster.  All of which need to be cast as quickly as possible(in the same round if possible) Area and action denile are the game(assuming he doesn't have acid resistance(which he's stupid if he doesn't have, and immunity to cloudkill(which is popular for being a retarded easy kill for just about anything so again retarded if he can't deal with it... heck a scroll of epic dispel is within his grasp... so why bother...)

I know MY epic rogue was able to escape force cages with mundane skill(epic skill use for the win) so at most he would be slowed down by the cages. And honestly there are several tricks for getting around the spell setup, all of which are fairly low level and easy to aquire for any epic character(specially rogues) ...

But again... my suggestion is that you don't try to fight, and just keep adventuring.   OR you may end up with ALL your belongings missing and you dead.   


I'm on board with you but my party wants vengence.  I also whole-heartedly agree that those items should not be in our possession anyways.

Definitely don't rely on cloudkill, it's just a poison and most high level characters (including the party) should already be immune to poisons.

Edit to note: Scrying has SR, so don't expect to find him that easily.

I mentioned before that this rogue is part of The Garrotte.  The Garrotte does not take kindly to its members being killed so I have prepared this letter for them.  Please note there are a handful of campaign references.

I hope business is well as per usual.


I write this letter in hope that you read it to its completion so that you can fully appreciate the knowledge here-in. I present to you the information here-in with all honesty as a priest of Hera and may she smite me with all of her wrath if I lie to you within this most humble of letters. I would also like you to know that I write this letter without the knowledge of any of my companions so if you feel the need to discuss its contents I would be more then happy to.


My colleagues and I have had some very negative encounters with a member of your organization named Brutus. Our first direct encounter with him began just after our bard Onion out-manoeuvred him in the purchase of several paintings in the city of Cobis, Lamsey. I use the words direct encounter as we had heard of Brutus before hand but I will get to our previous knowledge of him which in due course.


After being out-manoeuvred Brutus proceeded to steal these paintings from us. To me, this was nothing albeit slightly petty; your man clearly seemed like a poor loser. Brutus, so emotionally-hurt by being out-manoeuvred he proceeded to steal from not only the Gnomish Bard but also everyone he travelled with: myself and my colleagues. Again, not significant but very petty indeed. After trying to confront him and prevent further thefts we only broiled his base emotions further and he once again stole from us; several powerful epic items. This last theft has forced my hand to take action and this letter is the first and I feel the most important part of said action.


My colleagues and I first heard of Brutus after capturing his underling Tick. Now I will share with you what we learned from Tick and his own underlings but to prove to you that what I am saying is true, you can ask him yourself. Tick is currently sequestered as per the spell in the Church of St. Andrew in Cobis. He is lying inside a confessional that has been nailed shut and if you so wish you can ask him your own questions.


Tick told us that Brutus was his boss and the leader of The Organization, an assassin guild running independently of The Garrotte and taking contracts from the Gnomish Empire without your consent. I understand that this the deepest violation of Garrotte code: "Finally, every member must understand and accept the structure of freelance killing. No one takes a job not approved by the guild masters. They have their reasons for the contracts they take and the ones they refuse, and any member who won't abide by that isn't long for this world." I'm not entirely sure if this is part of your charter or if you even have a charter but Brutus has been in direct violation of this most sacred code of the Garrotte. Once again proof of this can be gleaned from Tick.


The reason behind me telling you this is three-fold: (1) Prevent further theft (2) the restoration of the confidence of my associates and (3) the retrieval of the items that were stolen from us; all in increasing order of importance to me. My colleagues would likely list these reasons in a different order but I am a priest and my motivations are more humble or I so I hope. My goal in telling you this is not the death of Brutus but this would insistently solve all of my problems. I am personally not interested in the items that Brutus has on his person nor his gold repertoire; what with his non-sanctioned contracts must be fairly substantial. I am a priest so my desires are more modest... perhaps not as modest a priest of Athena or Apollo but modest none-the-less.

Result: Huge Success!   Thanks for your help everyone, especially Oxybe and Unknown.

Order of Events:
(1) Discern Location on the epic scimitar: inside a crate in a warehouse on the Material Plane
(2) Teleport there and negotiate with the police there (our political allies)
(3) Taunt the epic rogue via Sending; appears inside the crate; triggers us to cast Forcecage and AMF
(4) He escapes with an epic spell
(5) He brakes into our abode that evening with a Wizard; sets off alarm spells; flees scene
(6) Our commander informs us that her spies found out that he is hiding in a demi plane
(7) Travel there; find him through Dragon Sight; triggers us to cast Forcecage and AMF; Wizard almost reacts
(8) Epic rogue escapes cage somehow, accepts the letter in previous post which had a Trap the Soul on it along with the Nydus's Magical Aura spell: CAPTURED.  Our sorcerer made several comments that cannot be posted here
(9) Cleric casts Last Judgement on the Wizard

(10) Negotiated with The Garrotte:
We Give Up:
-This Epic Rogue who is currently captured inside a gem
-A significant portion of the epic magic items he was carrying
We Gain:
- +10 Resistance Robe with Detect Scrying
- +10 Strength Belt with Pass Without Trace
- Ring of Universal Energy Immunity
- Ironskin Ring
- +48 Disguise Kit
- All the wizard's items (+6 INT, spellbook, +8 brace of armour, wand of greater planeshift)
- All the stolen (above stated items) are returned
- The Garrotte agrees to force this rogue to disband his malicious Assassin Guild
- In good favour with The Garrotte

Yeah, at least it partially solves the problem. Still, I guess he had to be a good sport about it to have it end well for you guys at all. Could have just as easily been like "Oh, this rogue is friends with 20 dragons!"

I'd think it doesn't solve the problem...at all.  If anything, I think it makes the problem worse.  Wasn't the whole entire point of the gear being taken that the DM made a mistake in giving it and was trying to correct it?  Now the gear has been recovered and additional obsenely powerful items are thrown into the mix which further increases the original problem.  Isn't this how PC/DM arm races generally begin?  Further red flag being the DM wasn't completely pleased.  I dunno, it just seems like he made a mistake and despite his best attempts isn't able to live it down.

No, this rogue was kind of the BBEG of the campaign.  I don't think the DM had a notion of us being able to bring him down at such a low level but we felt that we needed to after he began stealing from us.  In addition the campaign will be so coming to a close because of time restraints that University is bringing on for our DM so things are no-where near as bad in our campaign as they appear to be in this thread.
