During my current campaign my kobold necromancer requires a body of an fiendish penguin as a component for making a creature than is essentially a Prinny however the DM has ruled that summons vanish upon death leaving no body so I a currently stumped on a method of obtaining fiendish penguins. So if anyone knows of any spells or method I would be greatful.

You could go to hell, or put a want ad in the local adventurer's guild.

Outside of using a wish or similar magic, or travelling to the outer planes to catch one, the most basic way of obtaining one would be to make friendly contact with something in the lower planes and asking nicely.

But it's most likely not going to be worth the price you'll pay for it.

Well most adventurers will accept gold, if you have enough of it.
But they do seem to qualify.
You use your undead army (you are a necromancer) and try to invade hell.

Just do it.
I'm telling you, it will end up the most awesome adventure ever.

Does your character know any diviners / know divination spells? If so, try using divination to find one / find someone to buy one from / find a way to get one.

Cast Gate or a Calling spell as opposed to Summons.

...fiendish penguin...

Not to be a downer or anything but...well, are you sure that this isn't just your DM's way of telling you "no, you can't have a prinny"? Unless you're playing an intentionally silly campaign, a fiendish penguin sounds like the kind of non-existent component that an annoyed DM would require of a PC, specifically because he knows that the PC can't find it.

But assuming that fiendish penguins do indeed leap gleefully from the slimy waters of the Styx river, my best advice would be to find someone knowledgeable about the lower planes or actually go there yourself, depending on how high level you are.
